SYNOPSIS AS INTRODUCED:
720 ILCS 5/11-1.25 new

Amends the Criminal Code of 2012. Provides that a person commits sexual assault by deception if the person commits an act of sexual penetration and the victim submits under the belief that the person committing the act is someone known to the victim other than the accused, and this belief is induced by pretense or concealment by the accused with the intent to induce that belief. Sexual assault by deception is a Class 3 felony.

1 AN ACT concerning criminal law.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Criminal Code of 2012 is amended by adding
5Section 11-1.25 as follows:
6 (720 ILCS 5/11-1.25 new)
7 Sec. 11-1.25. Sexual assault by deception.
8 (a) A person commits sexual assault by deception if the
9person commits an act of sexual penetration and the victim
10submits under the belief that the person committing the act is
11someone known to the victim other than the accused, and this
12belief is induced by pretense or concealment by the accused
13with the intent to induce that belief.
14 (b) Sentence. Sexual assault by deception is a Class 3
15felony.
