Amends the Mental Health and Developmental Disabilities Code. Makes a technical change in a Section concerning persons under a legal disability.

1 AN ACT concerning health.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Mental Health and Developmental
5Disabilities Code is amended by changing Section 2-101 as
6follows:
7 (405 ILCS 5/2-101) (from Ch. 91 1/2, par. 2-101)
8 Sec. 2-101. No recipient of services shall be presumed to
9be a person under a legal disability, nor shall such person be
10held to be a person under a legal disability except as
11determined by a court. Such determination shall be separate
12from a judicial proceeding held to determine whether a person
13is subject to involuntary admission or meets the the standard
14for judicial admission.
