1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Park District Code is amended by changing
5Sections 2-12 and 2-12a as follows:
6 (70 ILCS 1205/2-12) (from Ch. 105, par. 2-12)
7 Sec. 2-12. Except as may be otherwise determined pursuant
8to Section 2-12a the commissioners shall be elected for 6 year
9terms in all districts now or hereafter organized with the
10exceptions provided in Sections 2-10 and 2-10a as to those
11first elected.
12 In all General Park Districts commissioners shall be
13elected biennially to take the place of those whose terms
14expire. Such elections shall take place at the election
15provided by the general election law.
16 Commissioners shall serve until their successors are
17elected and qualified. A commissioner shall not be elected to
18more than 2 terms under this Section or Section 2-12a.

21 Sec. 2-12a. Any district may provide, either by resolution
22of the board or by referendum, that the term of commissioners

1shall be 4 years rather than 6 years. Any such referendum shall
2be initiated and held in the same manner as is provided by the
3general election law for public questions authorized by Article
4VII of the Illinois Constitution.
5 If a majority of the votes cast on the proposition is in
6favor of a 4-year term for commissioners, or if the Board
7adopts a resolution stating that it is acting pursuant to this
8Section to change the term of office from 6 years to 4 years,
9commissioners thereafter elected, commencing with the first
10regular park district election at least 60 days after the date
11on which the proposition for 4-year terms was approved at
12referendum or by resolution, shall be elected for a term of 4
13years. In order to provide for the transition from 6-year terms
14to 4-year terms, if 2 commissioners are to be elected at the
15first such election and if the term of only one commissioner is
16scheduled to expire in the year of the next election at which
17commissioners are elected, of the 2 commissioners elected, one
18shall serve a 2-year term and one a 4-year term, to be
19determined by lot between the 2 persons elected within 30 days
20after the election.
21 In any district where the board has created 4-year terms
22pursuant to this Section, whether by referendum or by
23resolution, the length of terms may later be increased to 6
24years, but only by a referendum initiated and held in the same
25manner as prescribed in this Section for creating 4-year terms.
26No proposition to increase the terms of commissioners shall

1affect any commissioner holding office at the time of the
2referendum or to be elected within 60 days of the referendum.
3 A commissioner shall not be elected to more than 2 terms
4under this Section or Section 2-12, except that a 2-year term
5of a commissioner as prescribed in this Section shall not count
6as one of the 2 elected terms.
