New Act

1 AN ACT concerning State government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the Local
5Initiative Sunshine Act.
6 Section 5. Definitions. In this Act:
7 "Gubernatorial or legislative member initiative" means a
8grant from State funds to a specific unit of local government,
9specific school district, specific not-for-profit
10organization, or specific non-governmental entity for
11infrastructure improvements or operating expenses. Grants that
12are part of a statewide program and are based on generally
13applicable standards of eligibility are not gubernatorial or
14legislative member initiatives.
15 "Infrastructure improvements" include without limitation
16capital improvements, capital projects, planning,
17construction, reconstruction, equipment, utilities, vehicles,
18and all costs associated with economic development, community
19programs, educational programs, public health, and public
20safety.
21 "Initiative sponsor", with respect to each gubernatorial
22or legislative member initiative, includes the Governor and
23each member of the General Assembly designated in the grant

1application as having requested or initiated the grant.
2 "Initiative recipient" means an individual or entity that
3is designated to receive or receives a gubernatorial or
4legislative member initiative.
5 "Recoverable grants" mean grant money to an initiative
6recipient that has been determined, in accordance with
7applicable State law and rule, to be refundable to the State.
8 "Searchable database website" means a website that allows
9the public to (i) search the database by name of initiative
10recipient, initiative sponsor, funding agency, and location of
11performed and recoverable grants and (ii) download data
12included in item (i), including outcomes from searches.
13 Section 10. Purpose. The purpose of this Act is to provide
14full and complete disclosure to the public of the recipients of
15gubernatorial and legislative member initiatives. The database
16shall also serve as a warning to initiative recipients that the
17misuse of public funds will not be tolerated by the State.
18 Section 15. Initiative recipient database.
19 (a) Beginning on July 1, 2017 or on the effective date of
20this Act, whichever is later, the Office of the Comptroller
21shall create and maintain a searchable database website
22containing information concerning initiative recipients. The
23database shall include for each initiative recipient:
24 (1) the name of the initiative recipient and initiative

1 sponsor;
2 (2) the amount of the gubernatorial or legislative
3 member initiative;
4 (3) the funding agency and the funding source;
5 (4) the purpose of each initiative;
6 (5) the location of the initiative recipient and the
7 primary location of the performance of the initiative;
8 (6) any recoverable grants; and
9 (7) any other relevant information.
10 (b) The database website shall also provide an opportunity
11for the public to provide input about the utility of the
12website and recommendations for improvements.
13 (c) The database website shall not be considered in
14compliance with this Act if it relies upon links to other
15existing websites and databases, unless each of those sites has
16information from all agencies and each category of information
17required to be itemized can be searched electronically by field
18in a single search.
19 Section 99. Effective date. This Act takes effect upon
20becoming law.
