SYNOPSIS AS INTRODUCED:
105 ILCS 5/27-2.5 new

Amends the School Code. If any payments from this State to a school district are delayed for at least one payment cycle, then allows the school board to discontinue, by publicly adopted resolution, any instructional mandate in the Courses of Study Article of the School Code during that time (with exceptions). Provides that if a student requests information on any instructional mandate that has been discontinued, then the school district shall provide the student with the requested information. Effective immediately.

1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The School Code is amended by adding Section
527-2.5 as follows:
6 (105 ILCS 5/27-2.5 new)
7 Sec. 27-2.5. Instructional mandate discontinuance.
8 (a) For the purposes of this Section, "instructional
9mandate" means any State law in this Article that requires a
10school district to devote any amount of time to the instruction
11of or engagement by students in a subject or course.
12 (b) Notwithstanding Section 2-3.25g or any other provision
13of this Code, if any payments from this State to a school
14district are delayed for at least one payment cycle, then the
15school board may discontinue, by publicly adopted resolution,
16any instructional mandate in this Article. This Section,
17however, does not permit a school board to discontinue by
18resolution the requirements set forth in Sections 27-5, 27-6,
1927-7, and 27-22 of this Code and Sections 27-24 through 27-24.8
20of this Code.
21 (c) If a student requests information on any instructional
22mandate that has been discontinued under this Section, then the
23school district shall provide the student with the requested

2 (d) The State Board of Education may adopt any rules that
3it deems necessary for the implementation of this Section.
4 Section 99. Effective date. This Act takes effect upon
5becoming law.
