1 | AN ACT concerning regulation.

2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Safe Pharmaceutical Disposal Act is amended | ||||||
5 | by changing Section 17 as follows:
| ||||||
6 | (210 ILCS 150/17) | ||||||
7 | Sec. 17. Pharmaceutical disposal. Notwithstanding any
| ||||||
8 | provision of law, any county, city, village, or municipality | ||||||
9 | may
authorize the use of its city hall , or police department , | ||||||
10 | or other facility to
display a container suitable for use as a | ||||||
11 | receptacle for used,
expired, or unwanted pharmaceuticals. | ||||||
12 | These used, expired, or
unwanted pharmaceuticals may include | ||||||
13 | unused medication and prescription drugs, as well as controlled | ||||||
14 | substances if collected in accordance with federal law. This
| ||||||
15 | receptacle shall only permit the deposit of items, and the
| ||||||
16 | contents shall be locked and secured. The container shall be
| ||||||
17 | accessible to the public and shall have posted clearly legible
| ||||||
18 | signage indicating that expired or unwanted prescription drugs
| ||||||
19 | may be disposed of in the receptacle. The city, village, or | ||||||
20 | municipality shall provide continuous or regular notice to the | ||||||
21 | public regarding the availability of the receptacle. | ||||||
22 | Pharmaceuticals disposed of under this Act may be destroyed in | ||||||
23 | a drug destruction device in accordance with Section 22.58 of |

1 | the Environmental Protection Act.

3 | Section 10. The Environmental Protection Act is amended by | ||||||
4 | changing Section 22.58 as follows:

6 | Sec. 22.58. Drug destruction by law enforcement agency. | ||||||
7 | (a) For purposes of this Section: | ||||||
8 | "Drug destruction device" means a device that is (i) | ||||||
9 | designed by its manufacturer to destroy drug evidence and | ||||||
10 | render it non-retrievable and (ii) used exclusively for that | ||||||
11 | purpose. | ||||||
12 | "Drug evidence" means any illegal drug collected as | ||||||
13 | evidence by a law enforcement agency or any used, expired, or | ||||||
14 | unwanted pharmaceuticals collected under the Safe | ||||||
15 | Pharmaceutical Disposal Act . "Drug evidence" does not include | ||||||
16 | hazardous waste. | ||||||
17 | "Drug" "Illegal drug" means any one or more of the | ||||||
18 | following when obtained without a prescription or otherwise in | ||||||
19 | violation of the law: | ||||||
20 | (1) any substance as defined and included in the | ||||||
21 | Schedules of Article II of the Illinois Controlled | ||||||
22 | Substances Act; | ||||||
23 | (2) any cannabis as defined in Section 3 of the | ||||||
24 | Cannabis Control Act; or |

1 | (3) any drug as defined in paragraph (b) of Section 3 | ||||||
2 | of the Pharmacy Practice Act. | ||||||
3 | "Law enforcement agency" means an agency of this State or | ||||||
4 | unit of local government that is vested by law or ordinance | ||||||
5 | with the duty to maintain public order and to enforce criminal | ||||||
6 | laws or ordinances. | ||||||
7 | "Non-retrievable" means the condition or state following a | ||||||
8 | process that permanently alters the illegal drug's physical or | ||||||
9 | chemical condition or state through irreversible means and | ||||||
10 | thereby renders the illegal drug unavailable and unusable for | ||||||
11 | all practical purposes. | ||||||
12 | (b) To the extent allowed under federal law, drug evidence | ||||||
13 | that is placed into a drug destruction device by a law | ||||||
14 | enforcement agency at the location where the evidence is stored | ||||||
15 | by the agency and that is destroyed under the supervision of | ||||||
16 | the agency in accordance with the specifications of the device | ||||||
17 | manufacturer shall not be considered discarded or a waste under | ||||||
18 | this Act until it is rendered non-retrievable.
