1 AN ACT concerning regulation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Safe Pharmaceutical Disposal Act is amended
5by changing Section 17 as follows:
6 (210 ILCS 150/17)
7 Sec. 17. Pharmaceutical disposal. Notwithstanding any
8provision of law, any county, city, village, or municipality
9may authorize the use of its city hall , or police department,
10or other facility to display a container suitable for use as a
11receptacle for used, expired, or unwanted pharmaceuticals.
12These used, expired, or unwanted pharmaceuticals may include
13unused medication and prescription drugs, as well as controlled
14substances if collected in accordance with federal law. This
15receptacle shall only permit the deposit of items, and the
16contents shall be locked and secured. The container shall be
17accessible to the public and shall have posted clearly legible
18signage indicating that expired or unwanted prescription drugs
19may be disposed of in the receptacle. The city, village, or
20municipality shall provide continuous or regular notice to the
21public regarding the availability of the receptacle.
22Pharmaceuticals disposed of under this Act may be destroyed in
23a drug destruction device in accordance with Section 22.58 of

1the Environmental Protection Act.

3 Section 10. The Environmental Protection Act is amended by
4changing Section 22.58 as follows:
5 (415 ILCS 5/22.58)
6 Sec. 22.58. Drug destruction by law enforcement agency.
7 (a) For purposes of this Section:
8 "Drug destruction device" means a device that is (i)
9designed by its manufacturer to destroy drug evidence and
10render it non-retrievable and (ii) used exclusively for that
11purpose.
12 "Drug evidence" means any illegal drug collected as
13evidence by a law enforcement agency or any used, expired, or
14unwanted pharmaceuticals collected under the Safe
15Pharmaceutical Disposal Act. "Drug evidence" does not include
16hazardous waste.
17 "Drug" "Illegal drug" means any one or more of the
18following when obtained without a prescription or otherwise in
19violation of the law:
20 (1) any substance as defined and included in the
21 Schedules of Article II of the Illinois Controlled
22 Substances Act;
23 (2) any cannabis as defined in Section 3 of the
24 Cannabis Control Act; or

1 (3) any drug as defined in paragraph (b) of Section 3
2 of the Pharmacy Practice Act.
3 "Law enforcement agency" means an agency of this State or
4unit of local government that is vested by law or ordinance
5with the duty to maintain public order and to enforce criminal
6laws or ordinances.
7 "Non-retrievable" means the condition or state following a
8process that permanently alters the illegal drug's physical or
9chemical condition or state through irreversible means and
10thereby renders the illegal drug unavailable and unusable for
11all practical purposes.
12 (b) To the extent allowed under federal law, drug evidence
13that is placed into a drug destruction device by a law
14enforcement agency at the location where the evidence is stored
15by the agency and that is destroyed under the supervision of
16the agency in accordance with the specifications of the device
17manufacturer shall not be considered discarded or a waste under
18this Act until it is rendered non-retrievable.
