Bill Title: Amends the Illinois Vehicle Code. Provides that no person shall stand on a highway for the purpose of soliciting money or contributions (rather than just contributions) from the occupant of any vehicle except within a municipality when expressly permitted by municipal ordinance. Provides that any person engaged in the act of solicitation under an ordinance shall be 16 years of age or more and shall be wearing a high visibility vest.

SYNOPSIS AS INTRODUCED:
625 ILCS 5/11-1006 from Ch. 95 1/2, par. 11-1006

Amends the Illinois Vehicle Code. Provides that no person shall stand, sit, or stay on a street or roadway for the purpose of soliciting money from the occupant of any vehicle. A person convicted of violating the provision shall be guilty of a Class A misdemeanor.

1 AN ACT concerning transportation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by changing
5Section 11-1006 as follows:
6 (625 ILCS 5/11-1006) (from Ch. 95 1/2, par. 11-1006)
7 Sec. 11-1006. Pedestrians soliciting rides or business.
8 (a) No person shall stand in a roadway for the purpose of
9soliciting a ride from the driver of any vehicle.
10 (b) No person shall stand on a highway for the purpose of
11soliciting employment or business from the occupant of any
12vehicle.
13 (c) No person shall stand on a highway for the purpose of
14soliciting contributions from the occupant of any vehicle
15except within a municipality when expressly permitted by
16municipal ordinance. The local municipality, city, village, or
17other local governmental entity in which the solicitation takes
18place shall determine by ordinance where and when solicitations
19may take place based on the safety of the solicitors and the
20safety of motorists. The decision shall also take into account
21the orderly flow of traffic and may not allow interference with
22the operation of official traffic control devices. The
23soliciting agency shall be:

1 1. registered with the Attorney General as a charitable
2 organization as provided by "An Act to regulate
3 solicitation and collection of funds for charitable
4 purposes, providing for violations thereof, and making an
5 appropriation therefor", approved July 26, 1963, as
6 amended;
7 2. engaged in a Statewide fund raising activity; and
8 3. liable for any injuries to any person or property
9 during the solicitation which is causally related to an act
10 of ordinary negligence of the soliciting agent.
11 Any person engaged in the act of solicitation shall be 16
12years of age or more and shall be wearing a high visibility
13vest.
14 (c-5) Except as provided in subsection (c) of this Section,
15no person shall stand, sit, or stay on a street or roadway for
16the purpose of soliciting money from the occupant of any
17vehicle.
18 (d) No person shall stand on or in the proximity of a
19highway for the purpose of soliciting the watching or guarding
20of any vehicle while parked or about to be parked on a highway.
21 (e) Every person who is convicted of a violation of this
22Section shall be guilty of a Class A misdemeanor.
