| 1 | AMENDMENT TO SENATE BILL 1090
| ||||||
| 2 | AMENDMENT NO. ______. Amend Senate Bill 1090 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Attorney General Act is amended by adding | ||||||
| 5 | Section 10 as follows:
| ||||||
| 6 | (15 ILCS 205/10 new) | ||||||
| 7 | Sec. 10. Complaint data collection. | ||||||
| 8 | (a) The Attorney General shall compile data concerning | ||||||
| 9 | accessibility violations and post that information on the | ||||||
| 10 | Internet website of the Attorney General as provided under this | ||||||
| 11 | Section. | ||||||
| 12 | (b) The Attorney General shall identify the various types | ||||||
| 13 | of construction-related physical access violations alleged in | ||||||
| 14 | complaints, and shall tabulate the number of claims alleged for | ||||||
| 15 | each type of violation in the complaints and the number of | ||||||
| 16 | complaints in which the alleged violations were founded. | ||||||

| 1 | (c) Periodically, but not less than every 6 months | ||||||
| 2 | beginning July 31, 2020, the Attorney General shall post on the | ||||||
| 3 | Internet website of the Attorney General a list, by type, of | ||||||
| 4 | the 10 most frequent types of accessibility violations alleged | ||||||
| 5 | in the complaints and the number of alleged violations for each | ||||||
| 6 | listed type of violation for the prior 2 quarters, as well as | ||||||
| 7 | the number of complaints in which the alleged violations were | ||||||
| 8 | founded. | ||||||
| 9 | (d) The Attorney General shall, on a quarterly basis, | ||||||
| 10 | identify and tabulate the number of accessibility violation | ||||||
| 11 | complaints received by the Office of the Attorney General and | ||||||
| 12 | the number of those complaints received by the Attorney General | ||||||
| 13 | in which the alleged violations were founded. The Attorney | ||||||
| 14 | General shall further ascertain whether a complaint was filed | ||||||
| 15 | in State or federal court, and tabulate the number of | ||||||
| 16 | complaints filed in State or federal court, respectively. This | ||||||
| 17 | data shall be posted on the Attorney General's Internet website | ||||||
| 18 | periodically, but not less than every 6 months beginning July | ||||||
| 19 | 31, 2020. | ||||||
| 20 | (e) Beginning in 2020, and for each year thereafter, the | ||||||
| 21 | Attorney General shall submit an annual report to the General | ||||||
| 22 | Assembly on or before January 31 of the tabulated data for the | ||||||
| 23 | preceding calendar year as provided under subsections (b), (c), | ||||||
| 24 | and (d).
| ||||||
| 25 | Section 99. Effective date. This Act takes effect upon | ||||||
