| 4 | | "Section 5. The Counties Code is amended by changing |
| 5 | | Section 3-7002 as follows:

| 6 | | (55 ILCS 5/3-7002) (from Ch. 34, par. 3-7002)

| 7 | | Sec. 3-7002. Cook County Sheriff's Merit Board. There is |
| 8 | | created the
Cook County Sheriff's Merit Board, hereinafter |
| 9 | | called the Board, consisting
of 7 members appointed by the |
| 10 | | Sheriff with the advice and consent of
three-fifths of the |
| 11 | | county
board, except that on and after the effective date of |
| 12 | | this amendatory Act of
1997, the Sheriff may appoint 2 |
| 13 | | additional members, with the advice and
consent of three-fifths |
| 14 | | of the county board, at his or her discretion. Of the members |
| 15 | | first
appointed, one shall serve until the third Monday in |
| 16 | | March, 1965 one until the
third Monday in March, 1967, and one |
|

| 1 | | until the third Monday in March, 1969. Of
the 2 additional |
| 2 | | members first appointed under authority of this amendatory Act

the third Monday in March, 1997.
Of the 2 |
| 5 | | additional members first appointed under the authority of this
|
| 6 | | amendatory Act of
the 91st General Assembly, one shall serve |
| 7 | | until the third Monday in March,
2005 and
one shall serve until |
| 8 | | the third Monday in March, 2006.

| 9 | | Upon the expiration of the terms of office of those first |
| 10 | | appointed
(including the 2 additional members first appointed |
| 11 | | under authority of
this amendatory Act of 1991 and under the |
| 12 | | authority of this amendatory Act of
the
91st General Assembly), |
| 13 | | their respective successors shall be
appointed to hold office |
| 14 | | from the third Monday in March of the year of
their respective |
| 15 | | appointments for a term of 6 years and until their
successors |
| 16 | | are appointed and qualified for a like term. As additional
|
| 17 | | members are appointed under authority of this amendatory Act of |
| 18 | | 1997, their
terms shall be set to be staggered consistently |
| 19 | | with the terms of the existing
Board members. |
| 20 | | Notwithstanding any provision in this Section to the |
| 21 | | contrary, the term of office of each member of the Board is |
| 22 | | abolished on the effective date of this amendatory Act of the |
| 23 | | 100th General Assembly. Of the 7 members first appointed after |
| 24 | | the effective date of this Act of the 100th General Assembly, 2 |
| 25 | | shall serve until the third Monday in March 2019, 2 shall serve |
| 26 | | until the third Monday in March 2021, and 3 members shall serve |

| 1 | | until the third Monday in March 2023. The terms of the 2 |
| 2 | | additional members first appointed after the effective date of |
| 3 | | this Act of the 100th General Assembly shall be staggered |
| 4 | | consistently with the terms of the other Board members. |
| 5 | | Successors shall be appointed to hold office from the third |
| 6 | | Monday in March of the year of their respective appointments |
| 7 | | for a term of 6 years. Each member of the Board shall hold |
| 8 | | office until his or her successor is appointed and qualified. |
| 9 | | In the case of a vacancy in the office of a member prior to |
| 10 | | the conclusion of the member's term, the Sheriff shall, with |
| 11 | | the advice and consent of three-fifths of the county board, |
| 12 | | appoint a person to serve for the remainder of the unexpired |
| 13 | | term. |
| 14 | | No more than 3
members of the Board shall be affiliated |
| 15 | | with the same political party,
except that as additional |
| 16 | | members are appointed by the Sheriff under authority
of this |
| 17 | | amendatory Act of 1997 and under the authority of this |
| 18 | | amendatory Act
of the 91st General Assembly, the political |
| 19 | | affiliation of the Board shall be
such that no more than |
| 20 | | one-half of the members plus one additional member may
be |
| 21 | | affiliated with the same political party. No member shall have |
| 22 | | held or have
been a candidate for an elective public office |
| 23 | | within one year preceding his or
her appointment.

| 24 | | The Sheriff may deputize members of the Board.
