1 | AMENDMENT TO HOUSE BILL 2433

2 | AMENDMENT NO. ______. Amend House Bill 2433 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Nursing Home Care Act is amended by adding | ||||||
5 | Section 3-808.10 as follows:
| ||||||
6 | (210 ILCS 45/3-808.10 new) | ||||||
7 | Sec. 3-808.10. Nursing Home Complaint Working Group. | ||||||
8 | (a) The Nursing Home Complaint Working Group is created. | ||||||
9 | The purpose of the Working Group is to provide the Department, | ||||||
10 | local health departments, and nursing homes the ability to | ||||||
11 | resolve nursing home complaints. This purpose includes, but is | ||||||
12 | not limited to, the Working Group discussing local health | ||||||
13 | department jurisdictions and ways to improve the care of | ||||||
14 | nursing home residents. | ||||||
15 | (b) The Working Group shall: | ||||||
16 | (1) develop a system to review nursing home |

1 | complaints; | ||||||
2 | (2) review nursing home complaints and provide | ||||||
3 | appropriate recommendations; and | ||||||
4 | (3) expand duties and responsibilities as it deems | ||||||
5 | appropriate. | ||||||
6 | (c) The Working Group shall consist of the following | ||||||
7 | permanent members: | ||||||
8 | (1) the Director, or his or her designee, who shall | ||||||
9 | serve as chairperson; | ||||||
10 | (2) a representative of an organization representing | ||||||
11 | local health departments, appointed by the Director; | ||||||
12 | (3) a representative of a union representing nursing | ||||||
13 | staff, appointed by the Director; and | ||||||
14 | (4) a representative of an organization representing | ||||||
15 | nursing homes, appointed by the Director. | ||||||
16 | The Working Group may increase its membership or consult | ||||||
17 | with relevant stakeholders as it deems appropriate. | ||||||
18 | If a vacancy occurs in the Working Group membership, the | ||||||
19 | vacancy shall be filled in the same manner as the original | ||||||
20 | appointment. | ||||||
21 | (d) Working Group members shall serve without compensation | ||||||
22 | but shall be reimbursed for their expenses incurred in | ||||||
23 | performing their duties. | ||||||
24 | (e) The Working Group shall meet on a quarterly basis | ||||||
25 | starting within the first quarter of the year in which the | ||||||
26 | effective date of this amendatory Act of the 102nd General |

1 | Assembly occurs. | ||||||
2 | (f) The Working Group shall produce a quarterly and annual | ||||||
3 | progress report that summarizes its work and makes | ||||||
4 | recommendations resulting from its study, to be submitted to | ||||||
5 | the Office of the Governor and the General Assembly. The | ||||||
6 | quarterly progress report must be submitted no later than the | ||||||
7 | end of each respective quarter. The annual progress report | ||||||
8 | must be submitted no later than December 31 of each year. | ||||||
9 | (g) The Department shall provide administrative and other | ||||||
10 | support to the Working Group.

11 | Section 99. Effective date. This Act takes effect upon | ||||||
12 | becoming law.".
