AMENDMENT TO HOUSE BILL 537
2 AMENDMENT NO. ______. Amend House Bill 537 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Election Code is amended by changing
5Section 12-5 and by adding Section 28-8.2 as follows:
6 (10 ILCS 5/12-5) (from Ch. 46, par. 12-5)
7 Sec. 12-5. Notice for public questions.
8 (a) Except as otherwise provided in subsection (b), for all
9elections held after July 1, 1999, notice of public questions
10shall be required only as set forth in this Section and Section
1128-8.2 of this Code or as set forth in Section 17-3 or 19-3 of
12the School Code. Not more than 60 30 days nor less than 40 10
13days before the date of a regular election at which a public
14question is to be submitted to the voters of a political or
15governmental subdivision, and at least 20 days before an
16emergency referendum, the election authority shall publish

1notice of the referendum. The notice shall be published once in
2a local, community newspaper having general circulation in the
3political or governmental subdivision. The notice shall also be
4given at least 10 days before the date of the election by
5posting a copy of the notice at the principal office of the
6election authority. The local election official shall also post
7a copy of the notice at the principal office of the political
8or governmental subdivision, or if there is no principal office
9at the building in which the governing body of the political or
10governmental subdivision held its first meeting of the calendar
11year in which the referendum is being held. The election
12authority and the political or governmental subdivision may,
13but are not required to, post the notice electronically on
14their World Wide Web pages. The notice, which shall appear over
15the name or title of the election authority, shall be
16substantially in the following form:
17 NOTICE IS HEREBY GIVEN that at the election to be held
18 on (insert day of the week), (insert date of election), the
19 following proposition will be submitted to the voters of
20 (name of political or governmental subdivision):
21 (insert the public question as it will appear on the
22 ballot)
23 The polls at the election will be open at 6:00 o'clock
24 A.M. and will continue to be open until 7:00 o'clock P.M.
25 of that day.

1 (Name or title of the election authority)
2The notice shall also include any additional information
3required by the statute authorizing the public question. The
4notice may include an explanation, in neutral and plain
5language, of the question and its purposes supplied by the
6governing body of the political or governmental subdivision to
7whose voters the question is to be submitted. The notice shall
8set forth the precincts and polling places at which the
9referendum will be conducted only in the case of emergency
10referenda.
11 (b) Notice of any public question published in a local,
12community newspaper having general circulation in the
13political or governmental subdivision to which such public
14question and Section 28-8.2 of this Code relates more than 30
15days but not more than 35 days prior to the general election
16held on November 8, 2016 that otherwise complies with the
17requirements of this Section is sufficient notice to satisfy
18the newspaper publication requirement of this Section, such
19notice shall for all purposes be deemed to have been given in
20accordance with this Section, any bonds approved by the voters
21at such election are hereby authorized to be issued in
22accordance with applicable law without further referendum
23approval and taxes to be levied pursuant to any limiting rate
24increases approved by the voters at such election are hereby
25authorized to be levied and extended without further referendum
26approval.

2 (10 ILCS 5/28-8.2 new)
3 Sec. 28-8.2. Revenue referenda disclosure.
4 (a) For purposes of this Section, "revenue referenda" means
5referenda by a unit of local government, including a school
6district, seeking to impose or increase a retailers' occupation
7tax, a use tax, a service occupation tax, a service use tax, or
8a property tax, or regarding the issuance of bonds.
9 (b) If not already required by the Property Tax Extension
10Limitation Law, all revenue referenda shall have printed
11thereon, but not as part of the proposition submitted, only the
12following supplemental information (which shall be supplied to
13the election authority by the taxing district) in substantially
14the following form:
15 (1) The approximate amount of taxes extendable at the
16 most recently extended limiting rate is $...., and the
17 approximate amount of taxes extendable if the proposition
18 is approved is $....
19 (2) For the (insert the first full levy year for which
20 the new rate or increased limiting rate will be applicable)
21 levy year the approximate amount of the additional tax
22 extendable against property containing a single family
23 residence and having a fair market value at the time of the
24 referendum of $100,000 is estimated to be $....
25 (3) For this Bond Referendum, (name of local unit of

1 government or school district) proposes to issue bonds for
2 (state purpose for the bond) in the amount of (state the
3 principal amount of the bond) $... for the purpose of
4 paying the costs thereof that mature in (state the life of
5 the bond) years along with estimated interest costs of
6 (state the estimated amount) $... assuming an annual
7 interest rate at the time of the referendum of (state the
8 estimated percent) ...%. The average cost of the bond sale
9 including principal and estimated interest at the time of
10 this referendum for property containing a single family
11 residence and having a fair market value at the time of the
12 referendum of $100,000 is estimated to be $...
13 Section 99. Effective date. This Act takes effect upon
14becoming law.".
