AMENDMENT TO HOUSE BILL 537
2 AMENDMENT NO. ______. Amend House Bill 537 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Election Code is amended by changing
5Section 12-5 and by adding Section 28-8.2 as follows:
6 (10 ILCS 5/12-5) (from Ch. 46, par. 12-5)
7 Sec. 12-5. Notice for public questions. For all elections
8held after July 1, 1999, notice of public questions shall be
9required only as set forth in this Section and Section 28-8.2
10of this Code or as set forth in Section 17-3 or 19-3 of the
11School Code. Not more than 60 30 days nor less than 40 10 days
12before the date of a regular election at which a public
13question is to be submitted to the voters of a political or
14governmental subdivision, and at least 20 days before an
15emergency referendum, the election authority shall publish
16notice of the referendum. The notice shall be published once in

1a local, community newspaper having general circulation in the
2political or governmental subdivision. The notice shall also be
3given at least 10 days before the date of the election by
4posting a copy of the notice at the principal office of the
5election authority. The local election official shall also post
6a copy of the notice at the principal office of the political
7or governmental subdivision, or if there is no principal office
8at the building in which the governing body of the political or
9governmental subdivision held its first meeting of the calendar
10year in which the referendum is being held. The election
11authority and the political or governmental subdivision may,
12but are not required to, post the notice electronically on
13their World Wide Web pages. The notice, which shall appear over
14the name or title of the election authority, shall be
15substantially in the following form:
16 NOTICE IS HEREBY GIVEN that at the election to be held
17 on (insert day of the week), (insert date of election), the
18 following proposition will be submitted to the voters of
19 (name of political or governmental subdivision):
20 (insert the public question as it will appear on the
21 ballot)
22 The polls at the election will be open at 6:00 o'clock
23 A.M. and will continue to be open until 7:00 o'clock P.M.
24 of that day.
25 Dated (date of notice)
26 (Name or title of the election authority)

1The notice shall also include any additional information
2required by the statute authorizing the public question and
3Section 28-8.2 of this Code. The notice may include an
4explanation, in neutral and plain language, of the question and
5its purposes supplied by the governing body of the political or
6governmental subdivision to whose voters the question is to be
7submitted. The notice shall set forth the precincts and polling
8places at which the referendum will be conducted only in the
9case of emergency referenda.

12 Sec. 28-8.2. Revenue referenda disclosure.
13 (a) For purposes of this Section, "revenue referenda" means
14referenda by a unit of local government, including a school
15district, seeking to impose or increase a retailers' occupation
16tax, a use tax, a service occupation tax, a service use tax, or
17a property tax, or regarding the issuance of bonds.
18 (b) Revenue referenda shall contain the following
19information:
20 (1) the amount of the new or increased tax or bond;
21 (2) the amount that this proposed imposition or
22 increase will impact the unit of local government's current
23 taxes or bonds;
24 (3) if a bond, the projected life of the bond and the
25 estimated amounts of principal, interest, and total debt

1 service; and
2 (4) an example of the impact the new property tax or
3 bond is estimated to have on a family owning a residence
4 worth $100,000, both before and after the issuance of the
5 property tax or bond.
6 (c) In addition to other notice and publication
7requirements as may be otherwise required by law, the unit of
8local government proposing revenue referenda shall publish the
9referenda questions, along with the required disclosures under
10subsection (b) of this Section, no more than 60 days nor less
11than 40 days prior to the referenda appearing on the ballot in
12a newspaper of general circulation published in the unit of
13local government or school district and on the unit of local
14government's or school district's website and community
15newsletter, if they have one.
16 Section 99. Effective date. This Act takes effect upon
17becoming law.".
