S.F. _____ Section 1. NEW SECTION . 455F.12 Fire fighting foam —— 1 perfluoroalkyl or polyfluoroalkyl substances prohibited —— 2 exceptions. 3 1. For purposes of this section, unless the context 4 otherwise requires: 5 a. “Class B fire fighting foam” means foam designed to 6 extinguish flammable-liquid fires. 7 b. “Perfluoroalkyl substance” or “polyfluoroalkyl substance” 8 means a class of fluorinated organic chemicals that contain 9 at least one fully fluorinated carbon atom and that are 10 designed to be fully functional in class B fire fighting foam 11 formulations. 12 c. “Testing” means calibration testing, conformance testing, 13 or fixed system testing. 14 2. Except as otherwise provided, a person shall not use a 15 class B fire fighting foam that contains an intentionally added 16 perfluoroalkyl substance or polyfluoroalkyl substance. 17 3. Subsection 2 does not apply under any of the following 18 circumstances: 19 a. The use occurs in fire prevention or in response to an 20 emergency fire fighting operation. 21 b. The use is for training or testing purposes and occurs 22 at a facility that has implemented appropriate containment, 23 treatment, and disposal measures to prevent the release of such 24 class B fire fighting foam into the environment. 25 4. This section shall not be construed to restrict or 26 prevent the manufacture, sale, or distribution of class 27 B fire fighting foam that contains an intentionally added 28 perfluoroalkyl substance or polyfluoroalkyl substance. 29 Sec. 2. EFFECTIVE DATE. This Act takes effect January 1, 30 2021. 31 EXPLANATION 32 The inclusion of this explanation does not constitute agreement with 33 the explanation’s substance by the members of the general assembly. 34 This bill relates to the use of class B fire fighting 35 -1- LSB 5353XC (1) 88 js/ns 1/ 2
S.F. _____ foam containing perfluoroalkyl substances or polyfluoroalkyl 1 substances. 2 The bill prohibits a person from using a class B fire 3 fighting foam that contains a perfluoroalkyl substance or a 4 polyfluoroalkyl substance that was intentionally added. The 5 bill creates exceptions for use that occurs in response to an 6 emergency fire fighting operation or as part of training or 7 testing under certain conditions. The bill does not restrict 8 or prevent the manufacture, sale, or distribution of a class 9 B fire fighting foam that contains an intentionally added 10 perfluoroalkyl substance or polyfluoroalkyl substance. 11 By operation of law, a violation of the bill is a simple 12 misdemeanor. A simple misdemeanor is punishable by confinement 13 for no more than 30 days or a fine of at least $65 but not more 14 than $625 or by both. 15 The bill takes effect January 1, 2021. 16 -2- LSB 5353XC (1) 88 js/ns 2/ 2
