S.F. _____ H.F. _____ Section 1. APPOINTED STATE OFFICERS. 1 1. The governor shall establish a salary for appointed 2 nonelected persons in the executive branch of state government 3 who hold a position enumerated in the section of this Act that 4 addresses the salary ranges of state officers, within the range 5 provided, by considering, among other items, the experience of 6 the individual in the position, changes in the duties of the 7 position, the incumbent’s performance of assigned duties, and 8 subordinates’ salaries. However, the attorney general shall 9 establish the salary for the consumer advocate, the chief 10 justice of the supreme court shall establish the salary for 11 the state court administrator, the Iowa public information 12 board shall establish the salary of the executive director, the 13 ethics and campaign disclosure board shall establish the salary 14 of the executive director, and the Iowa public broadcasting 15 board shall establish the salary of the administrator of the 16 public broadcasting division of the department of education, 17 each within the salary range provided in the section of this 18 Act that addresses salary ranges of state officers. 19 2. The governor, in establishing salaries as provided in 20 this section, shall take into consideration other employee 21 benefits which may be provided for an individual including but 22 not limited to housing. 23 3. A person whose salary is established pursuant to this 24 section and who is a full-time, year-round employee of the 25 state shall not receive any other remuneration from the state 26 or from any other source for the performance of that person’s 27 duties unless the additional remuneration is first approved by 28 the governor or authorized by law. However, this provision 29 does not exclude the reimbursement for necessary travel and 30 expenses incurred in the performance of duties or fringe 31 benefits normally provided to employees of the state. 32 Sec. 2. STATE OFFICERS —— SALARY RANGE. The following 33 annual salary ranges are effective for the positions specified 34 in this section for the fiscal year beginning July 1, 2015, and 35 -1- LSB 1035XG (12) 86 tm/rj 1/ 11

The governor or other person designated in 2 the section of this Act relating to appointed state officers 3 shall determine the salary to be paid to the person indicated 4 at a rate within this salary range from funds appropriated by 5 the general assembly for that purpose. 6 1. The following are range 3 positions: administrator of 19 the division of criminal and juvenile justice planning of the 20 department of human rights, administrator of the division of 21 community action agencies of the department of human rights, 22 executive director of the department of veterans affairs, and 23 chairperson and members of the employment appeal board of the 24 department of inspections and appeals. 25 4. The following are range 4 positions: director of the 26 department of human rights, director of the Iowa state civil 27 rights commission, executive director of the college student 28 aid commission, director of the department for the blind, 29 executive director of the ethics and campaign disclosure 30 board, executive director of the Iowa public information 31 board, members of the public employment relations board, and 32 chairperson, vice chairperson, and members of the board of 33 parole. 34 5. S.F. _____ H.F. _____ department of homeland security and emergency management, state 1 public defender, drug policy coordinator, labor commissioner, 2 workers’ compensation commissioner, director of the department 3 of cultural affairs, director of the department of elder 4 affairs, director of the law enforcement academy, members of 5 the property assessment appeal board, and administrator of the 6 historical division of the department of cultural affairs. 7 6. The following are range 6 positions: superintendent of 8 banking, superintendent of credit unions, administrator of the 9 alcoholic beverages division of the department of commerce, 10 director of the department of inspections and appeals, 11 commandant of the Iowa veterans home, commissioner of public 12 safety, commissioner of insurance, executive director of the 13 Iowa finance authority, director of the department of natural 14 resources, consumer advocate, and chairperson of the utilities 15 board. The other members of the utilities board shall receive 16 an annual salary within a range of not less than 90 percent 17 but not more than 95 percent of the annual salary of the 18 chairperson of the utilities board. 19 7. The following are range 7 positions: administrator 20 of the public broadcasting division of the department of 21 education, director of the department of corrections, director 22 of the department of education, director of human services, 23 director of the economic development authority, executive 24 director of the Iowa telecommunications and technology 25 commission, executive director of the state board of regents, 26 director of transportation, director of the department of 27 workforce development, director of revenue, director of public 28 health, state court administrator, director of the department 29 of management, chief information officer, and director of the 30 department of administrative services. 31 Sec. 3. COLLECTIVE BARGAINING AGREEMENTS FUNDED. The 32 various state departments, boards, commissions, councils, and 33 agencies, including the state board of regents and the judicial 34 branch, for the fiscal years beginning July 1, 2015, and July 35 -3- LSB 1035XG (12) 86 tm/rj 3/ 11
S.F. _____ H.F. _____ 1, 2016, shall provide from available sources pay adjustments, 1 expense reimbursements, and related benefits to fully fund the 2 following: 3 1. The collective bargaining agreement negotiated pursuant 4 to chapter 20 for employees in the blue collar bargaining unit. 5 2. The collective bargaining agreement negotiated pursuant 6 to chapter 20 for employees in the public safety bargaining 7 unit. 8 3. The collective bargaining agreement negotiated pursuant 9 to chapter 20 for employees in the security bargaining unit. 10 4. The collective bargaining agreement negotiated pursuant 11 to chapter 20 for employees in the technical bargaining unit. 12 5. The collective bargaining agreement negotiated pursuant 13 to chapter 20 for employees in the professional fiscal and 14 staff bargaining unit. 15 6. The collective bargaining agreement negotiated pursuant 16 to chapter 20 for employees in the clerical bargaining unit. 17 7. The collective bargaining agreement negotiated pursuant 18 to chapter 20 for employees in the professional social services 19 bargaining unit. 20 8. The collective bargaining agreement negotiated pursuant 21 to chapter 20 for employees in the community-based corrections 22 bargaining unit. 23 9. The collective bargaining agreements negotiated 24 pursuant to chapter 20 for employees in the judicial branch of 25 government bargaining units. 26 10. The collective bargaining agreement negotiated pursuant 27 to chapter 20 for employees in the patient care bargaining 28 unit. 29 11. The collective bargaining agreement negotiated pursuant 30 to chapter 20 for employees in the science bargaining unit. 31 12. The collective bargaining agreement negotiated pursuant 32 to chapter 20 for employees in the university of northern Iowa 33 faculty bargaining unit. 34 13. The collective bargaining agreement negotiated pursuant 3 to chapter 20 for employees in the state university of Iowa 4 hospital and clinics tertiary health care bargaining unit. 5 15. The annual pay adjustments, related benefits, and 6 expense reimbursements referred to in the sections of this 7 Act addressing noncontract state and state board of regents 8 employees who are not covered by a collective bargaining 9 agreement. 10 Sec. 4. NONCONTRACT STATE EMPLOYEES —— GENERAL. 11 1. For the fiscal year beginning July 1, 2015: 12 a. The maximum and minimum salary levels of all pay plans 13 provided for in section 8A.413, subsection 3, as they exist for 14 the fiscal year ending June 30, 2015, shall be increased by 2.5 15 percent for the pay period beginning June 19, 2015. 16 b. Employees may receive a step increase or the equivalent 17 of a step increase. 18 c. Notwithstanding the increase in paragraph “a”, the 19 pay plan for noncontract judicial branch employees shall be 20 increased by 2.5 percent for the pay period beginning June 19, 21 2015. 22 d. The pay plans for state employees who are exempt 23 from chapter 8A, subchapter IV, and who are included in the 24 department of administrative services’ centralized payroll 25 system shall be increased by 2.5 percent for the pay period 26 beginning June 19, 2015, and any additional changes in any 27 executive branch pay plans shall be approved by the governor. 28 2. For the fiscal year beginning July 1, 2016: 29 a. The maximum and minimum salary levels of all pay plans 30 provided for in section 8A.413, subsection 3, as they exist for 31 the fiscal year ending June 30, 2016, shall be increased by 32 2.25 percent for the pay period beginning July 1, 2016. 33 b. The maximum and minimum salary levels of all pay plans 34 provided for in section 8A.413, subsection 3, as they exist for 35 -5- LSB 1035XG (12) 86 tm/rj 5/ 11
S.F. _____ H.F. _____ the pay period ending December 29, 2016, shall be increased by 1 1.25 percent for the pay period beginning December 30, 2016. 2 c. Employees may receive a step increase or the equivalent 3 of a step increase. 4 d. Notwithstanding the increase in paragraph “a”, the 5 pay plan for noncontract judicial branch employees shall be 6 increased by 2.25 percent for the pay period beginning July 1, 7 2016, and by 1.25 percent for the pay period beginning December 8 30, 2016. 9 e. The pay plans for state employees who are exempt 10 from chapter 8A, subchapter IV, and who are included in the 11 department of administrative services’ centralized payroll 12 system shall be increased by 2.25 percent for the pay period 13 beginning July 1, 2016, and by 1.25 percent for the pay period 14 beginning December 30, 2016, and any additional changes in any 15 executive branch pay plans shall be approved by the governor. 16 3. This section does not apply to members of the general 17 assembly, board members, commission members, persons whose 18 salaries are set by the general assembly pursuant to this Act 19 or are set by the governor, or other persons designated in 20 the section of this Act addressing appointed state officers, 21 employees designated under section 8A.412, subsection 5, and 22 employees covered by 11 IAC 53.6(3). 23 4. a. The pay plans for the bargaining eligible employees 24 of the state shall be increased by 2.5 percent for the pay 25 period beginning June 19, 2015, and any additional changes 26 in such executive branch pay plans shall be approved by the 27 governor. 28 b. The pay plans for the bargaining eligible employees of 29 the state shall be increased by 2.25 percent for the pay period 30 beginning July 1, 2016, and by 1.25 percent for the period 31 beginning December 30, 2016, and any additional changes in such 32 executive branch pay plans shall be approved by the governor. 33 c. As used in this subsection, “bargaining eligible 34 employee” means an employee who is eligible to organize under 35 -6- LSB 1035XG (12) 86 tm/rj 6/ 11
S.F. _____ H.F. _____ chapter 20, but has not done so. 1 5. The policies for implementation of this section shall be 2 approved by the governor. 3 Sec. 5. STATE EMPLOYEES —— STATE BOARD OF REGENTS. For the 4 fiscal years beginning July 1, 2015, and July 1, 2016, funds 5 shall be provided from available sources of the state board of 6 regents for funding of collective bargaining agreements for 7 state board of regents employees covered by such agreements and 8 for the following state board of regents employees not covered 9 by a collective bargaining agreement: 10 1. Regents merit system employees and merit supervisory 11 employees. 12 2. Faculty members and professional and scientific 13 employees. 14 Sec. 6. STATE COURT —— JUSTICES, JUDGES, AND MAGISTRATES. 15 1. The salary rates specified in subsection 2 are for the 16 fiscal year beginning July 1, 2015, effective for the pay 17 period beginning June 19, 2015, and for subsequent fiscal years 18 until otherwise provided by the general assembly. The salaries 19 provided for in this section shall be paid from funds allocated 20 to the judicial branch from the salary adjustment fund, or if 21 the allocation is not sufficient, from funds appropriated to 22 the judicial branch pursuant to this Act or any other Act of 23 the general assembly. 24 2. The following annual salary rates shall be paid to the 25 persons holding the judicial positions indicated during the 26 fiscal year beginning July 1, 2015, effective with the pay 27 period beginning June 19, 2015, and for subsequent pay periods. 28 a. Persons receiving the salary rates established 17 under this section shall not receive any additional salary 18 adjustments provided by this Act or any other Act of the 19 general assembly. 20 Sec. 7. SPECIAL FUNDS. 21 1. For the fiscal year beginning July 1, 2015, and ending 22 June 30, 2016, salary adjustments otherwise provided for 23 in this Act may be funded as determined by the department 24 of management using unappropriated funds remaining in the 25 department of commerce revolving fund, the gaming enforcement 26 revolving fund, the gaming regulatory revolving fund, the 27 primary road fund, the road use tax fund, the fish and game 28 protection fund, and the Iowa public employees’ retirement fund 29 and in other departmental revolving, trust, or special funds 30 for which the general assembly has not made an operating budget 31 appropriation. 32 2. For the fiscal year beginning July 1, 2016, and ending 33 June 30, 2017, salary adjustments otherwise provided for 34 in this Act may be funded as determined by the department 35 -8- LSB 1035XG (12) 86 tm/rj 8/ 11
S.F. _____ H.F. _____ of management using unappropriated funds remaining in the 1 department of commerce revolving fund, the gaming enforcement 2 revolving fund, the gaming regulatory revolving fund, the 3 primary road fund, the road use tax fund, the fish and game 4 protection fund, and the Iowa public employees’ retirement fund 5 and in other departmental revolving, trust, or special funds 6 for which the general assembly has not made an operating budget 7 appropriation. 8 Sec. 8. FEDERAL FUNDS APPROPRIATED. For the fiscal years 9 beginning July 1, 2015, and July 1, 2016, all federal grants 10 to and the federal receipts of the agencies affected by this 11 Act which are received and may be expended for purposes of this 12 Act are appropriated for those purposes and as set forth in the 13 federal grants or receipts. 14 Sec. 9. STATE TROOPER MEAL ALLOWANCE. For the fiscal years 15 beginning July 1, 2015, and July 1, 2016, the sworn peace 16 officers in the department of public safety who are not covered 17 by a collective bargaining agreement negotiated pursuant to 18 chapter 20 shall receive the same per diem meal allowance as 19 the sworn peace officers in the department of public safety who 20 are covered by a collective bargaining agreement negotiated 21 pursuant to chapter 20. 22 Sec. 10. SALARY MODEL ADMINISTRATOR. The salary model 23 administrator shall work in conjunction with the legislative 24 services agency to maintain the state’s salary model used for 25 analyzing, comparing, and projecting state employee salary 26 and benefit information, including information relating to 27 employees of the state board of regents. The department of 28 revenue, the department of administrative services, the five 29 institutions under the jurisdiction of the state board of 30 regents, the judicial district departments of correctional 31 services, and the state department of transportation shall 32 provide salary data to the department of management and the 33 legislative services agency to operate the state’s salary 34 model. The format and frequency of provision of the salary 35 -9- LSB 1035XG (12) 86 tm/rj 9/ 11
S.F. _____ H.F. _____ data shall be determined by the department of management and 1 the legislative services agency. The information shall be used 2 in collective bargaining processes under chapter 20 and in 3 calculating the funding needs for salary adjustment purposes. 4 A state employee organization as defined in section 20.3, 5 subsection 4, may request information produced by the model, 6 but the information provided shall not contain information 7 attributable to individual employees. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill relates to the funding for the fiscal years 12 beginning July 1, 2015, and July 1, 2016, of salary increases 13 for appointed nonelected officers, employees subject to 14 collective bargaining agreements, certain noncontract 15 employees, board of regents employees, and justices, judges, 16 and magistrates. 17 The salary ranges for appointed state officers are 18 increased. 19 The maximum and minimum salary levels of all pay plans of 20 noncontract state employees are increased and a step increase 21 or the equivalent of a step increase is authorized. 22 The annual salary rates for justices, judges, and 23 magistrates are increased. 24 The new salary ranges, levels, and rates first become 25 effective in June 2015. Some additional salary levels are 26 increased effective in July and December of 2016. 27 The bill allows salary adjustments otherwise provided for 28 in the bill to be funded as determined by the department 29 of management using unappropriated funds remaining in the 30 department of commerce revolving fund, the gaming enforcement 31 revolving fund, the gaming regulatory revolving fund, the 32 primary road fund, the road use tax fund, the fish and game 33 protection fund, and the Iowa public employees’ retirement fund 34 and in other departmental revolving, trust, or special funds 35 -10- LSB 1035XG (12) 86 tm/rj 10/ 11
