Section
123.132,
Code
2015,
is
amended
by
adding
1
the
following
new
unnumbered
paragraph:

UNNUMBERED
PARAGRAPH
.
Notwithstanding
any
provision
of
3
this
chapter
to
the
contrary,
a
holder
of
a
class
“C”
permit
4
may
permit
a
customer
to
remove
a
refillable
container
of
5
beer
for
consumption
off
the
premises.
The
permittee
or
the
6
permittees’s
agent
who
is
at
least
eighteen
years
of
age
shall
7
refill
the
container
and
shall
securely
seal
the
container
8
for
the
customer.
A
container
of
beer
sealed
pursuant
to
the
9
requirements
of
this
paragraph
shall
not
be
deemed
an
open
10
container
subject
to
the
requirements
of
sections
321.284
and
11
321.284A.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
a
person
holding
a
class
“C”
permit
16
authorized
to
sell
beer
for
consumption
off
the
licensed
17
premises
may
permit
a
customer
to
remove
a
refillable
container
18
of
beer
for
consumption
off
the
premises
that
is
refilled
19
and
sealed
by
the
permittee.
The
bill
requires
the
person
20
refilling
and
sealing
the
container
to
be
at
least
18
years
of
21
age.
The
bill
also
provides
that
the
sealed
container
of
beer
22
is
not
considered
an
open
container
for
purposes
of
those
Code
23
sections
prohibiting
open
containers
of
alcohol
in
vehicles.
