Section
1.
Section
103A.8A,
Code
2017,
is
amended
to
read
1
as
follows:

103A.8A
Energy
conservation
requirements.
3
1.
The
state
building
code
commissioner
shall
adopt
as
4
a
part
of
the
state
building
code
a
requirement
that
new
5
single-family
or
two-family
residential
construction
shall
6
comply
with
energy
conservation
requirements.
The
requirements
7
adopted
by
the
commissioner
shall
be
based
upon
a
nationally
8
recognized
standard
or
code
for
energy
conservation.
The
9
requirements
shall
only
apply
to
single-family
or
two-family
10
residential
construction
commenced
after
the
adoption
of
11
the
requirements.
Notwithstanding
any
other
provision
12
of
this
chapter
to
the
contrary,
the
energy
conservation
13
requirements
adopted
by
the
commissioner
and
approved
by
14
the
council
shall
apply
to
new
single-family
or
two-family
15
residential
construction
commenced
on
or
after
July
1,
2008,
16
and
shall
supersede
and
replace
any
minimum
requirements
for
17
energy
conservation
adopted
or
enacted
by
a
governmental
18
subdivision
prior
to
that
date
applicable
to
such
construction
19
to
all
single-family
or
two-family
residential
construction
20
commenced
on
or
after
July
1,
2010
.
The
state
building
code
21
commissioner
may
provide
training
to
builders,
contractors,
and
22
other
interested
persons
on
the
adopted
energy
conservation
23
requirements.

If
a
governmental
subdivision
has
adopted
minimum
25
energy
conservation
requirements
applicable
to
residential
26
construction
described
in
subsection
1
that
are
not
less
27
restrictive
than
the
minimum
energy
conservation
requirements
28
provided
in
the
international
energy
conservation
code,
2009
29
edition,
then
such
residential
construction
shall
comply
30
with
the
energy
conservation
requirements
adopted
by
the
31
governmental
subdivision
in
lieu
of
the
energy
conservation
32
requirements
adopted
by
the
commissioner.

Section
103A.10,
subsection
5,
Code
2017,
is
amended

by
striking
the
subsection.

RETROACTIVE
APPLICABILITY.
This
Act
applies
1
retroactively
to
July
1,
2010.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
4
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
energy
conservation
requirements
6
contained
within
the
state
building
code
or
adopted
by
7
governmental
subdivisions.
8
Code
chapter
103A
requires
new
single-family
or
two-family
9
residential
construction
commenced
on
or
after
July
1,
2008,
10
to
comply
with
energy
conservation
requirements
adopted
by
11
the
state
building
code
commissioner.
“New
construction”,
as
12
defined
in
the
Code
chapter,
is
expressly
made
inapplicable
13
to
building
renovations
and
repairs.
The
energy
conservation
14
requirements
adopted
by
the
state
building
code
commissioner
15
supersede
and
replace
any
minimum
energy
conservation
16
requirements
adopted
by
a
governmental
subdivision.

The
bill
amends
Code
section
103A.8A
to
provide
that
all
18
single-family
or
two-family
residential
construction
on
or
19
after
July
1,
2010,
shall
comply
with
the
energy
conservation
20
requirements,
extending
the
requirements
to
existing
residence
21
renovations
and
repairs.
22
The
bill
removes
the
language
from
Code
section
103A.8A
that
23
provides
that
the
energy
conservation
requirements
adopted
24
by
the
state
building
code
commissioner
are
to
supersede
any
25
minimum
requirements
adopted
by
a
governmental
subdivision.
26
The
bill
makes
conforming
changes
consistent
with
this
27
modification
by
striking
Code
section
103A.10(5).

The
bill
provides
that
if
a
governmental
subdivision
adopts
29
minimum
energy
conservation
requirements
that
are
not
less
30
restrictive
than
the
2009
edition
of
the
international
energy
31
conservation
code,
then
applicable
residential
construction
32
must
comply
with
the
energy
conservation
requirements
33
adopted
by
the
governmental
subdivision
in
lieu
of
the
energy
34
conservation
requirements
adopted
by
the
commissioner.
