S.F. _____ Section 1. Section 99D.7, subsection 23, Code 2017, is 1 amended to read as follows: 2 23. To require licensees to establish a process to allow a 3 person to be voluntarily excluded for life from the wagering 4 area of a racetrack enclosure and from the gaming floor, as 5 defined in section 99F.1, of all other licensed facilities 6 under this chapter and chapter 99F as provided in this 7 subsection. The process shall provide that an initial request 8 by a person to be voluntarily excluded shall be for a period 9 of five years or life and any subsequent request following any 10 five-year period shall be for a period of five years or life . 11 The process established shall also require that a licensee 12 disseminate information regarding persons voluntarily excluded 13 to all licensees under this chapter and chapter 99F . The state 14 and any licensee under this chapter or chapter 99F shall not 15 be liable to any person for any claim which may arise from this 16 process. In addition to any other penalty provided by law, any 17 money or thing of value that has been obtained by, or is owed 18 to, a voluntarily excluded person by a licensee as a result of 19 wagers made by the person after the person has been voluntarily 20 excluded shall not be paid to the person but shall be credited 21 to the general fund of the state. 22 Sec. 2. Section 99F.4, subsection 22, Code 2017, is amended 23 to read as follows: 24 22. To require licensees to establish a process to allow 25 a person to be voluntarily excluded for life from the gaming 26 floor of an excursion gambling boat and from the wagering 27 area, as defined in section 99D.2, and the gaming floor of all 28 other licensed facilities under this chapter and chapter 99D 29 as provided in this subsection. The process shall provide 30 that an initial request by a person to be voluntarily excluded 31 shall be for a period of five years or life and any subsequent 32 request following any five-year period shall be for a period of 33 five years or life . The state and any licensee under this chapter or 2 chapter 99D shall not be liable to any person for any claim 3 which may arise from this process. GAMBLING SELF-EXCLUSION —— REVOCATION. A person 10 who has been voluntarily excluded for life from a racetrack 11 enclosure, an excursion gambling boat, and all other licensed 12 facilities under Code chapters 99D and 99F pursuant to the 13 process established in Code sections 99D.7 and 99F.4 prior to 14 the effective date of this Act may revoke the exclusion by 15 filing a form with the racing and gaming commission in a manner 16 as prescribed by the racing and gaming commission. A person 17 may revoke the voluntary exclusion only if the person has been 18 voluntarily excluded for a period of at least five years. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill concerns the process by which a person can be 23 voluntarily excluded from a racetrack enclosure under Code 24 chapter 99D and from an excursion gambling boat and all other 25 licensed facilities under Code chapter 99F. 26 The bill provides that a person who is voluntarily excluded 27 shall be excluded only from the wagering area and gaming floor 28 of a licensed facility under Code chapters 99D and 99F. 29 The bill provides that an initial request to be voluntarily 30 excluded shall be for a period of five years or for life and any 31 subsequent request by that person after any five-year period 32 shall be for five years or life. Under current law, a request 33 to be voluntarily excluded is for life. 34 The bill also provides that for a person who has been 35 -2- LSB 2202XC (5) 87 ec/nh 2/ 3
