S.F. _____ Section 1. NEW SECTION . 169.21 Limitations of actions. 1 An action for professional negligence or malpractice for 2 injuries to a person or property against an individual licensed 3 under this chapter shall not be brought more than two years 4 after the date on which the claimant knew, or through the use 5 of reasonable diligence should have known, or received notice 6 in writing of the existence of, the injury for which damages 7 were sought in the action, whichever of the dates occurs first. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill provides a statute of limitations for an action 12 brought for professional negligence or malpractice against a 13 person licensed to practice veterinary medicine. 14 The bill provides that a person has two years after the date 15 the claimant knew, should have known, or received notice of the 16 injury for which damages are being sought to bring an action 17 against a person licensed to practice veterinary medicine. 18 Under current law, Code section 614.1(4) provides that 19 injuries to property shall be brought within five years of the 20 injury. 21 -1- LSB 2266XC (2) 89 cm/jh 1/ 1
