S.F. _____ Section 1. NEW SECTION . 135.39E Fluoridation in public 1 water supply —— notice of discontinuance. 2 1. At least ninety days prior to taking any action to 3 discontinue fluoridation in its water supply, an owner or 4 operator of a public water supply system, as defined in section 5 455B.171, shall provide notice to all of the following: 6 a. The local board. 7 b. The department. 8 c. The public water supply system’s customers. 9 2. In order to provide notice to its customers, the owner or 10 operator of the public water supply system shall place a notice 11 on each customer’s water bill or provide notice in a way that 12 is reasonably calculated so that all customers will receive the 13 notice. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill relates to requirements for providing notice 18 prior to discontinuing fluoridation in a public water supply 19 system. For purposes of the bill, a public water supply system 20 provides to the public piped water for human consumption and 21 has at least 15 service connections or regularly serves at 22 least 25 individuals. A public water supply system includes 23 any source of water and any collection, treatment, storage, and 24 distribution facilities under control of the operator of the 25 system and used primarily in connection with the system, and 26 any collection or pretreatment storage facilities not under 27 such control that are used primarily in connection with the 28 system. 29 The bill requires the owner or operator of a public water 30 supply system to provide notice to the local board of health, 31 the department of public health, and the public water supply 32 system’s customers at least 90 days prior to taking any action 33 to discontinue fluoridation in the system’s water supply. S.F. _____ customers by placing a notice on each customer’s water bill or 1 by providing notice in a way that is reasonably calculated so 2 that all customers will receive the notice. 3 By operation of law, a person who knowingly violates the 4 provisions of the bill is guilty of a simple misdemeanor.
