Senate Resolution 2 - Introduced SENATE RESOLUTION NO. 2 BY COURNOYER A Resolution urging the United States Congress to 1 reject the invitation to ignore Iowa election law 2 and Iowa’s judicial process in deciding election 3 disputes. 4 WHEREAS, on November 30, 2020, the Iowa State 5 Board of Canvass, including a bipartisan group of 6 statewide elected officials, certified Iowa’s second 7 congressional district election, declaring Mariannette 8 Miller-Meeks as the winner; and 9 WHEREAS, the opposing candidate, Rita Hart, could 10 have filed an election contest with Iowa’s judicial 11 system if she believed that certification to be in 12 error; and 13 WHEREAS, Hart chose to bypass Iowa’s judicial system 14 and bring her legal claims directly to the United 15 States House of Representatives; and 16 WHEREAS, Congress has declared in the past, 17 including in cases involving Iowa elections, that 18 losing candidates should exhaust state judicial 19 remedies before filing a contest in the United States 20 House of Representatives; and 21 WHEREAS, Hart has asked the United States House 22 of Representatives to ignore that precedent and 23 to encourage losing candidates to bypass the state 24 judicial process; and 25 WHEREAS, Hart is arguing that the United States 26 House of Representatives is “not legally bound to 27 follow state law” in deciding who won the election; and 28 -1- LSB 2502XS (1) 89 ss/rn 1/ 2
S.R. 2 WHEREAS, if these arguments are adopted, it would 1 set a negative precedent that would violate the will 2 of Iowa voters, upend the rule of law, and reduce 3 the public’s confidence in Iowa’s fair election 4 process; NOW THEREFORE, 5 BE IT RESOLVED BY THE SENATE, That the Iowa 6 Senate opposes an election process whereby defeated 7 candidates purposely bypass Iowa’s judicial system 8 to bring legal claims directly to the United States 9 House of Representatives when their party is in the 10 majority; and 11 BE IT FURTHER RESOLVED, That the United States House 12 of Representatives should not ignore Iowa election law, 13 which is passed and enacted by the representatives of 14 Iowans. 15 -2- LSB 2502XS (1) 89 ss/rn 2/ 2
