Section
1.
Section
29C.17A,
subsection
3,
Code
2019,
is
1
amended
to
read
as
follows:

3.
Information
disseminated
to
the
public
through
the
mass
3
notification
and
emergency
messaging
system
shall
be
limited
4
to
imminent
emergency
and
public
safety-related
issues.
For
5
purposes
of
this
section,
a
“public
safety-related
issue”
6
includes
the
circumstances
described
in
subsection
3A.
The
7
department
may
provide
access
to
the
system
for
use
at
the
8
county
and
local
level.
Access
by
a
county
or
local
government
9
shall
be
at
the
department’s
sole
discretion,
and
if
approved
10
by
the
department,
shall
be
under
the
control
of
the
local
11
commission.
The
commission
shall
establish
an
operational
plan
12
and
procedure
which
meets
standards
adopted
by
the
department
13
by
rule,
and
shall
submit
the
operational
plan
and
procedure
14
for
approval
by
the
department
prior
to
access
being
granted.
15
Additional
access
criteria
and
procedures
for
administering
the
16
fund
shall
be
established
by
the
department
by
rule.

2.
Section
29C.17A,
Code
2019,
is
amended
by
adding
the
18
following
new
subsection:

NEW
SUBSECTION
.
3A.
The
department
shall
adopt
rules
to
20
utilize
the
mass
notification
and
emergency
messaging
system
to
21
notify
the
public
about
an
endangered
missing
person,
together
22
with
information
that
could
assist
in
locating
and
providing
23
help
to
such
a
person.
For
purposes
of
this
subsection,
24
“endangered
missing
person”
means
a
person
of
any
age
who
25
is
missing,
who
may
be
in
danger
due
to
the
person’s
age
or
26
physical
or
mental
health
or
due
to
severe
weather
conditions,
27
and
who
may
be
unable
to
return
to
safety
without
assistance.
28
“Endangered
missing
person”
includes,
without
limitation,
a
29
veteran
as
defined
in
section
35.1
or
an
active
duty
member
of
30
the
armed
forces
of
the
United
States,
a
member
of
a
reserve
31
component
thereof,
or
a
member
of
the
national
guard,
who
has
32
a
physical
or
mental
health
condition
related
to
the
military
33
service
of
the
veteran
or
member
and
who
may
be
missing
as
a
34
result
of
that
condition.
