S.F. 61 Section 1. MORATORIUM ON REGULATIONS AFFECTING THE SALE OF 1 UNPROCESSED FOOD. 2 1. As used in this section, unless the context otherwise 3 requires: 4 a. “State agency” means any unit of state government 5 designated as an authority, board, commission, committee, 6 council, department, or independent agency as defined in 7 section 7E.4, including but not limited to each principal 8 central department enumerated in section 7E.5. 9 b. “Unprocessed food” means food that is an agricultural 10 commodity sold for consumption in its raw state without being 11 subjected to a change in form, condition, or temperature, 12 including but not limited to raw milk, eggs in the shell, 13 nuts in the shell, honey in the comb, fresh fruit, and fresh 14 vegetables. 15 2. Notwithstanding any other provision to the contrary, a 16 moratorium is declared on every state agency’s administration 17 and enforcement of statutes and rules affecting the sale of 18 unprocessed food in this state, including but not limited to 19 all of the following: 20 a. The issuance of permits or licenses. 21 b. The inspection of the unprocessed food or an 22 establishment that sells unprocessed food. 23 c. The labeling of unprocessed food or containers 24 containing unprocessed food. 25 3. This section takes effect July 1, 2014. 26 Sec. 2. REPORT BY STATE AGENCIES. The department of 27 agriculture and land stewardship, the department of public 28 health, and the department of inspections and appeals, shall 29 cooperate to publish and prepare a joint report to the general 30 assembly not later than January 1, 2014. The report shall 31 provide a list of all statutes and rules affected by this 32 Act and proposals to most effectively amend or repeal those 33 statutes and rules without affecting the administration and 34 enforcement of other provisions. 35 -1- LSB 1749XS (1) 85 da/nh 1/ 2
S.F. 61 EXPLANATION 1 This bill provides that, notwithstanding any other provision 2 to the contrary, a moratorium exists on every state agency’s 3 administration and enforcement of statutes and rules affecting 4 the sale of unprocessed food in this state. Unprocessed food 5 includes milk, eggs, nuts, honey, fruit, and vegetables. The 6 regulations include the issuance of permits or licenses, 7 the inspection of the unprocessed food or an establishment 8 that sells such food, and labeling. The moratorium takes 9 effect on July 1, 2014. By January 1, 2014, the department 10 of agriculture and land stewardship, the department of public 11 health, and the department of inspections and appeals must 12 submit a joint report to the general assembly outlining all 13 statutes and rules affected by the moratorium and proposals to 14 most effectively amend or repeal those statutes and rules. 15 -2- LSB 1749XS (1) 85 da/nh 2/ 2
