S.F. 576 DIVISION I 1 DATA COLLECTION —— DEPARTMENT OF PUBLIC HEALTH 2 Section 1. Section 135.166, subsection 2, Code 2019, is 3 amended to read as follows: 4 2. Unless otherwise authorized or required by state or 5 federal law, data collected under this section shall not 6 include the social security number or name of the individual 7 subject of the data. 8 DIVISION II 9 EMERGENCY MEDICAL SERVICES —— PATIENT MEDICAL INFORMATION 10 Sec. 2. NEW SECTION . 147A.4A Patient medical information 11 —— limitations. 12 1. Unless otherwise authorized or required by state or 13 federal law, or unless required for billing purposes, data 14 collected under this subchapter, including patient care 15 reports, that contain a patient’s medical information, shall 16 not include the social security number or name of the patient 17 who is the subject of the data. 18 2. For the purposes of this section: 19 a. “Patient care report” means a computerized or written 20 report that documents the assessment and management of a 21 patient by an emergency care provider in an out-of-hospital 22 setting. 23 b. “Patient’s medical information” means any information in 24 an emergency medical services ambulance or transport document 25 or report, including a patient care report, that identifies a 26 patient who is the subject of the information or with respect 27 to which there is a reasonable basis to believe that the 28 information could be used to identify the patient. 29 EXPLANATION 30 The inclusion of this explanation does not constitute agreement with 31 the explanation’s substance by the members of the general assembly. 32 This bill relates to the protection of certain patient 33 health data and information under the purview of the department 34 of public health (DPH). 35 -1- LSB 2751SV (2) 88 pf/rh 1/ 2
S.F. 576 HOSPITAL DATA. Division I of the bill provides that, with 1 regard to certain inpatient, outpatient, and ambulatory data 2 collected from hospitals, unless otherwise authorized or 3 required by state or federal law, in addition to the social 4 security number, the name of the individual subject of the data 5 shall not be included in data collected from hospitals by DPH. 6 EMERGENCY MEDICAL SERVICES. Division II of the bill 7 provides that, unless otherwise authorized or required by state 8 or federal law, or unless required for billing purposes, data 9 collected under Code chapter 147A, subchapter I (emergency 10 medical care), including patient care reports, that contain a 11 patient’s medical information, shall not include the social 12 security number or name of the patient who is the subject of 13 the data. 14 The division defines “patient care report” as a computerized 15 or written report that documents the assessment and 16 management of a patient by an emergency care provider in an 17 out-of-hospital setting; and “patient’s medical information” as 18 any information in an emergency medical services ambulance or 19 transport document or report, including a patient care report, 20 that identifies a patient who is the subject of the information 21 or with respect to which there is a reasonable basis to believe 22 that the information could be used to identify the patient. 23 -2- LSB 2751SV (2) 88 pf/rh 2/ 2
