Notwithstanding section 455A.10, the department may use 21 the unappropriated balance remaining in the state fish and 22 game protection fund for the fiscal year beginning July 1, 23 2011, and ending June 30, 2012, to provide for the funding of 24 health and life insurance premium payments from unused sick 25 leave balances of conservation peace officers employed in a 26 protection occupation who retire, pursuant to section 97B.49B. 27 3. Notwithstanding section 455A.10, the department of 28 natural resources may use the unappropriated balance remaining 29 in the state fish and game protection fund for the fiscal 30 year beginning July 1, 2011, and ending June 30, 2012, as is 31 necessary to fund salary adjustments for departmental employees 32 which the general assembly has made an operating budget 33 appropriation for in subsection 1. 34 Sec. 8. STORM WATER DISCHARGE PERMIT FEES —— SUPPORT FOR 32 SPECIAL PURPOSES. ELIMINATION OF CHIEF AND ASSISTANT CHIEF OF 14 THE LAW ENFORCEMENT BUREAU OF THE DEPARTMENT OF NATURAL 15 RESOURCES. Effective July 1, 2011, the position of assistant 16 chief of the law enforcement bureau of the department of 17 natural resources is eliminated. 18 Sec. 13. USE OF MONEYS SAVED FROM THE ELIMINATION OF 19 POSITION —— ADDITIONAL CONSERVATION OFFICER. For the fiscal 20 year beginning July 1, 2011, and ending June 30, 2012, the 21 department of natural resources shall use moneys saved by the 22 elimination of the position of assistant chief of the law 23 enforcement bureau of the department of natural resources 24 as provided in this division for purposes of supporting an 25 additional full-time equivalent position including salaries, 26 support, maintenance, and miscellaneous purposes. The 27 full-time equivalent position shall be a conservation officer 28 assigned to field duties. 29 DIVISION IV 30 IOWA STATE UNIVERSITY 31 Sec. 14. GENERAL FUND —— VETERINARY DIAGNOSTIC LABORATORY. 32 1. There is appropriated from the general fund of the state 33 to Iowa state university of science and technology for the 34 fiscal year beginning July 1, 2011, and ending June 30, 2012, 35 -6- SF 509 (4) 84 da/jp 6/ 14

Iowa state university of science and technology 9 shall not reduce the amount that it allocates to support the 10 college of veterinary medicine from any other source due to the 11 appropriation made in this section. 12 b. Paragraph “a” does not apply to a reduction made to 13 support the college of veterinary medicine, if the same 14 percentage of reduction imposed on the college of veterinary 15 medicine is also imposed on all of Iowa state university’s 16 budget units. 17 3. If by June 30, 2012, Iowa state university of science and 18 technology fails to allocate the moneys appropriated in this 19 section to the college of veterinary medicine in accordance 20 with this section, the moneys appropriated in this section for 21 that fiscal year shall revert to the general fund of the state. 22 DIVISION V 23 ENVIRONMENT FIRST FUND —— GENERAL APPROPRIATIONS 24 Sec. 15. DEPARTMENT OF AGRICULTURE AND LAND 25 STEWARDSHIP. There is appropriated from the environment first 26 fund created in section 8.57A to the department of agriculture 27 and land stewardship for the fiscal year beginning July 1, 28 2011, and ending June 30, 2012, the following amounts, or so 29 much thereof as is necessary, to be used for the purposes 30 designated: 31 1. CONSERVATION RESERVE ENHANCEMENT PROGRAM (CREP) 32 a. For the conservation reserve enhancement program to 33 restore and construct wetlands for the purposes of intercepting 34 tile line runoff, reducing nutrient loss, improving water 35 -7- SF 509 (4) 84 da/jp 7/ 14

AGRICULTURAL DRAINAGE WELL CLOSURE —— REPORT. The 4 department of agriculture and land stewardship shall prepare 5 a report regarding agricultural drainage wells that have not 6 been closed as provided in chapter 460. The report shall 7 include an inventory of agricultural drainage wells that remain 8 unclosed, a projected timeline for closing the agricultural 9 drainage wells, and an estimate of the costs for closing each 10 agricultural drainage well. The department shall submit the 11 report to the governor and fiscal services division of the 12 legislative services agency not later than November 15, 2011. 13 DIVISION VIII 14 RELATED STATUTORY CHANGES 15 Sec. 20. Section 455E.11, subsection 2, paragraph a, 16 subparagraph (1), subparagraph division (a), subparagraph 17 subdivision (ii), subparagraph part (B), Code 2011, is amended 18 to read as follows: 19 (B) Expend not more than fifty percent of the moneys 20 for a community partnership program designed to support 21 community beautification projects including the deconstruction, 22 renovation, or removal of derelict buildings. Eligible 23 communities are limited to cities of five thousand or fewer in 24 population. Eligible costs shall include but are not limited 25 to asbestos abatement and removal, the recovery and processing 26 of recyclable or reusable material from derelict buildings, and 27 reimbursement for purchased recycled content materials used 28 in the renovation of buildings. Special consideration may be 29 given to communities that hire the unemployed to deconstruct 30 structures, clean up the properties, and, if there is no 31 immediate buyer for the properties, turn the properties into 32 green spaces. Any business entity or individual engaged in the 33 removal or abatement of asbestos must have obtained a valid 34 license or permit as required in chapter 88B . 35 -12- SF 509 (4) 84 da/jp 12/ 14
S.F. 509 Sec. 21. Section 455E.11, subsection 2, paragraph a, 1 subparagraph (1), Code 2011, is amended by adding the following 2 new subparagraph division: 3 NEW SUBPARAGRAPH DIVISION . (0e) Not more than four 4 hundred thousand dollars to the department for purposes of 5 providing funding assistance to eligible communities to address 6 abandoned buildings by promoting waste abatement, diversion, 7 selective dismantlement of building components, and recycling. 8 Eligible communities include a city with a population of five 9 thousand or fewer. Eligible costs for program assistance 10 include but are not limited to asbestos and other hazardous 11 material abatement and removal, the recovery processing 12 of recyclable or reusable material through the selective 13 dismantlement of abandoned buildings, and reimbursement for 14 purchased recycled content materials used in the renovation of 15 buildings. For projects that support community beautification, 16 the department may elect to administer funding to eligible 17 communities in collaboration with the organization awarded the 18 beautification grant in accordance with subparagraph division 19 (a), subparagraph subdivision (i). 20 Sec. 22. Section 455G.3, subsections 6 and 7, Code 2011, are 21 amended to read as follows: 22 6. a. For the fiscal year beginning July 1, 2010, and each 23 fiscal year thereafter, there is appropriated from the Iowa 24 comprehensive petroleum underground storage tank fund to the 25 department of natural resources two hundred thousand dollars 26 for purposes of technical review support to be conducted by 27 nongovernmental entities for leaking underground storage tank 28 assessments. 29 b. Notwithstanding section 8.33, moneys appropriated in this 30 subsection that remain unencumbered or unobligated at the close 31 of the fiscal year shall not revert but shall remain available 32 for expenditure for the purposes designated until the close of 33 the succeeding fiscal year. 34 7. a. S.F. 509 appropriated from the Iowa comprehensive petroleum underground 1 storage tank fund to the department of natural resources one 2 hundred thousand dollars for purposes of database modifications 3 necessary to accept batched external data regarding underground 4 storage tank inspections conducted by nongovernmental entities. 5 b. Notwithstanding section 8.33, moneys appropriated in this 6 subsection that remain unencumbered or unobligated at the close 7 of the fiscal year shall not revert but shall remain available 8 for expenditure for the purposes designated until the close of 9 the succeeding fiscal year. 10 Sec. 23.
