ELIMINATION OF CHIEF AND ASSISTANT CHIEF OF 6 THE LAW ENFORCEMENT BUREAU OF THE DEPARTMENT OF NATURAL 7 RESOURCES. Effective July 1, 2011, the position of assistant 8 chief of the law enforcement bureau of the department of 9 natural resources is eliminated. 10 Sec. 13. USE OF MONEYS SAVED FROM THE ELIMINATION OF 11 POSITION —— ADDITIONAL CONSERVATION OFFICER. For the fiscal 12 year beginning July 1, 2011, and ending June 30, 2012, the 13 department of natural resources shall use moneys saved by the 14 elimination of the position of assistant chief of the law 15 enforcement bureau of the department of natural resources 16 as provided in this division for purposes of supporting an 17 additional full-time equivalent position including salaries, 18 support, maintenance, and miscellaneous purposes. The 19 full-time equivalent position shall be a conservation officer 20 assigned to field duties. 21 DIVISION IV 22 IOWA STATE UNIVERSITY 23 Sec. 14. GENERAL FUND —— VETERINARY DIAGNOSTIC LABORATORY. 24 1. Iowa state university of science and technology 1 shall not reduce the amount that it allocates to support the 2 college of veterinary medicine from any other source due to the 3 appropriation made in this section. 4 b. Paragraph “a” does not apply to a reduction made to 5 support the college of veterinary medicine, if the same 6 percentage of reduction imposed on the college of veterinary 7 medicine is also imposed on all of Iowa state university’s 8 budget units. 9 3. If by June 30, 2012, Iowa state university of science and 10 technology fails to allocate the moneys appropriated in this 11 section to the college of veterinary medicine in accordance 12 with this section, the moneys appropriated in this section for 13 that fiscal year shall revert to the general fund of the state. 14 DIVISION V 15 ENVIRONMENT FIRST FUND —— GENERAL APPROPRIATIONS 16 Sec. 15. DEPARTMENT OF AGRICULTURE AND LAND 17 STEWARDSHIP. There is appropriated from the environment first 18 fund created in section 8.57A to the department of agriculture 19 and land stewardship for the fiscal year beginning July 1, 20 2011, and ending June 30, 2012, the following amounts, or so 21 much thereof as is necessary, to be used for the purposes 22 designated: 23 1. CONSERVATION RESERVE ENHANCEMENT PROGRAM (CREP) 24 a. REVERSION. Notwithstanding section 8.33, 8 moneys appropriated for the fiscal year beginning July 1, 9 2011, in this division of this Act that remain unencumbered 10 or unobligated at the close of the fiscal year shall not 11 revert but shall remain available to be used for the purposes 12 designated until the close of the fiscal year beginning July 1, 13 2012, or until the project for which the appropriation was made 14 is completed, whichever is earlier. 15 DIVISION VI 16 RESOURCES ENHANCEMENT 17 AND PROTECTION (REAP) FUND 18 Sec. 18. ENVIRONMENT FIRST FUND. Notwithstanding the 19 amount of the standing appropriation from the general fund of 20 the state to the Iowa resources enhancement and protection 21 fund as provided in section 455A.18, there is appropriated 22 from the environment first fund created in section 8.57A to 23 the Iowa resources enhancement and protection fund, in lieu of 24 the appropriation made in section 455A.18, for the fiscal year 25 beginning July 1, 2011, and ending June 30, 2012, the following 26 amount, to be allocated as provided in section 455A.19: 27 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,375,000 28 DIVISION VII 29 RELATED MISCELLANEOUS PROVISIONS 30 Sec. 19. AGRICULTURAL DRAINAGE WELL CLOSURE —— REPORT. The 31 department of agriculture and land stewardship shall prepare 32 a report regarding agricultural drainage wells that have not 33 been closed as provided in chapter 460. The report shall 34 include an inventory of agricultural drainage wells that remain 35 -11- LSB 1001SV (2) 84 da/jp 11/ 16
S.F. 509 unclosed, a projected timeline for closing the agricultural 1 drainage wells, and an estimate of the costs for closing each 2 agricultural drainage well. The department shall submit the 3 report to the governor and fiscal services division of the 4 legislative services agency not later than November 15, 2011. 5 DIVISION VIII 6 RELATED STATUTORY CHANGES 7 Sec. 20. Section 455E.11, subsection 2, paragraph a, 8 subparagraph (1), subparagraph division (a), subparagraph 9 subdivision (ii), subparagraph part (B), Code 2011, is amended 10 to read as follows: 11 (B) Expend not more than fifty percent of the moneys 12 for a community partnership program designed to support 13 community beautification projects including the deconstruction, 14 renovation, or removal of derelict buildings. Eligible 15 communities are limited to cities of five thousand or fewer in 16 population. Eligible costs shall include but are not limited 17 to asbestos abatement and removal, the recovery and processing 18 of recyclable or reusable material from derelict buildings, and 19 reimbursement for purchased recycled content materials used 20 in the renovation of buildings. Special consideration may be 21 given to communities that hire the unemployed to deconstruct 22 structures, clean up the properties, and, if there is no 23 immediate buyer for the properties, turn the properties into 24 green spaces. Any business entity or individual engaged in the 25 removal or abatement of asbestos must have obtained a valid 26 license or permit as required in chapter 88B . 27 Sec. 21. Section 455E.11, subsection 2, paragraph a, 28 subparagraph (1), Code 2011, is amended by adding the following 29 new subparagraph division: 30 NEW SUBPARAGRAPH DIVISION . (0e) Not more than four 31 hundred thousand dollars to the department for purposes of 32 providing funding assistance to eligible communities to address 33 abandoned buildings by promoting waste abatement, diversion, 34 selective dismantlement of building components, and recycling. 35 -12- LSB 1001SV (2) 84 da/jp 12/ 16

Eligible costs for program assistance 2 include but are not limited to asbestos and other hazardous 3 material abatement and removal, the recovery processing 4 of recyclable or reusable material through the selective 5 dismantlement of abandoned buildings, and reimbursement for 6 purchased recycled content materials used in the renovation of 7 buildings. For projects that support community beautification, 8 the department may elect to administer funding to eligible 9 communities in collaboration with the organization awarded the 10 beautification grant in accordance with subparagraph division 11 (a), subparagraph subdivision (i). 12 Sec. 22. Section 455G.3, subsections 6 and 7, Code 2011, are 13 amended to read as follows: 14 6. a. For the fiscal year beginning July 1, 2010, and each 15 fiscal year thereafter, there is appropriated from the Iowa 16 comprehensive petroleum underground storage tank fund to the 17 department of natural resources two hundred thousand dollars 18 for purposes of technical review support to be conducted by 19 nongovernmental entities for leaking underground storage tank 20 assessments. 21 b. Notwithstanding section 8.33, moneys appropriated in this 22 subsection that remain unencumbered or unobligated at the close 23 of the fiscal year shall not revert but shall remain available 24 for expenditure for the purposes designated until the close of 25 the succeeding fiscal year. 26 7. a. For the fiscal year beginning July 1, 2010, there is 27 appropriated from the Iowa comprehensive petroleum underground 28 storage tank fund to the department of natural resources one 29 hundred thousand dollars for purposes of database modifications 30 necessary to accept batched external data regarding underground 31 storage tank inspections conducted by nongovernmental entities. 32 b. Notwithstanding section 8.33, moneys appropriated in this 33 subsection that remain unencumbered or unobligated at the close 34 of the fiscal year shall not revert but shall remain available 35 -13- LSB 1001SV (2) 84 da/jp 13/ 16
S.F. 509 for expenditure for the purposes designated until the close of 1 the succeeding fiscal year. 2 Sec. 23. EFFECTIVE UPON ENACTMENT. This division of this 3 Act, being deemed of immediate importance, takes effect upon 4 enactment. 5 EXPLANATION 6 GENERAL. This bill relates to agriculture and natural 7 resources by making appropriations for the 2011-2012 fiscal 8 year to support related entities, including the department of 9 agriculture and land stewardship, the department of natural 10 resources, and Iowa state university. 11 The bill appropriates moneys to the department of 12 agriculture and land stewardship and the department of natural 13 resources. The appropriations are made to support those 14 departments for administration, regulation, and programs. The 15 bill requires the departments to submit quarterly reports to 16 the general assembly and department of management regarding the 17 expenditure of appropriated moneys. The bill also provides 18 moneys to support specific programs or projects administered by 19 those departments. The bill appropriates moneys from a number 20 of sources, including the general fund of the state, the state 21 fish and game protection fund, the groundwater protection fund, 22 and the environment first fund. The bill is organized into 23 divisions. 24 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP. For the 25 department of agriculture and land stewardship, moneys are 26 appropriated in order to support its divisions. 27 The bill appropriates moneys from the general fund of the 28 state to support designated programs, including horse and dog 29 racing, motor fuel inspection, and agricultural education. 30 The bill appropriates moneys to support a local food and farm 31 coordinator contingent upon the enactment of S.F. 441. 32 DEPARTMENT OF NATURAL RESOURCES. For the department of 33 natural resources, moneys are appropriated from the general 34 fund in order to support its divisions. 35 -14- LSB 1001SV (2) 84 da/jp 14/ 16
S.F. 509 The bill makes appropriations from other funds. The bill 1 appropriates moneys to the department of natural resources from 2 the state fish and game protection fund to support programs 3 related to fish and wildlife. The bill appropriates moneys 4 from the groundwater protection fund to support groundwater 5 quality. The bill appropriates moneys from the snowmobile fund 6 to the department for snowmobile programs. 7 The bill includes miscellaneous provisions. An 8 appropriation is made from the unassigned revenue fund 9 administered by the Iowa comprehensive underground storage 10 tank fund board to the department of natural resources for 11 administration and expenses of the underground storage tank 12 section. 13 The bill provides that the department of natural 14 resources may use additional funds for staffing to reduce the 15 department’s floodplain permit backlog and implementing the 16 federal maximum daily load program. 17 ELIMINATION OF POSITION AND EXPENDITURE OF MONEYS. The 18 bill eliminates the assistant chief of the law enforcement 19 bureau of the department of natural resources. It authorizes 20 the department of natural resources to use savings from the 21 elimination to support one additional conservation officer. 22 IOWA STATE UNIVERSITY. The bill appropriates moneys from 23 the general fund of the state for the operation of the Iowa 24 state university’s veterinary diagnostic laboratory. 25 IOWA RESOURCES ENHANCEMENT AND PROTECTION FUND. The 26 bill appropriates moneys from the environment first fund to 27 support a number of programs administered by the department 28 of agriculture and land stewardship and the department of 29 natural resources. The bill also appropriates moneys from the 30 environment first fund to the Iowa resources enhancement and 31 protection fund in lieu of the $20 million appropriated by Code 32 section 455A.18 from the general fund of the state. 33 RELATED MISCELLANEOUS PROVISIONS. The department of 34 agriculture and land stewardship must submit a report to 35 -15- LSB 1001SV (2) 84 da/jp 15/ 16
S.F. 509 the governor and general assembly inventorying agricultural 1 drainage wells that remain unclosed. 2 RELATED STATUTORY CHANGES. The bill amends a provision in 3 Code section 455E.11 allocating moneys from the solid waste 4 account of the groundwater protection fund, by supporting 5 community beautification projects and allocates moneys 6 for purposes of providing funding assistance to eligible 7 communities to address abandoned buildings. 8 The bill amends a provision in Code section 455G.3 9 establishing an Iowa comprehensive petroleum underground 10 storage tank fund and provides an annual standing limited 11 appropriation from the fund to the department of natural 12 resources to support technical reviews of leaking underground 13 storage tank assessments. The bill also addresses a one-time 14 appropriation for database modifications regarding inspections 15 conducted by nongovernmental entities.
