  1  1    Section 1.  Section 299A.12, subsection 3, unnumbered
  1  2 paragraph 1, Code 2017, is amended to read as follows:
  1  3    Purposes Except as provided in subsection 4, purposes
  1  4  for which a school district shall not expend funds received
  1  5 pursuant to section 257.6, subsection 1, paragraph "a",
  1  6 subparagraph (5), include but are not limited to the following:
  1  7    Sec. 2.  Section 299A.12, Code 2017, is amended by adding the
  1  8 following new subsection:
  1  9    NEW SUBSECTION.  4.  Moneys received by a school district
  1 10 pursuant to section 257.6, subsection 1, paragraph "a",
  1 11 subparagraph (5), that remain unexpended or unobligated at
  1 12 the end of a budget year, shall be carried forward to the
  1 13 succeeding budget year and may be used according to subsection
  1 14 2 or for any of the following:
  1 15    a.  Indirect costs or use charges.
  1 16    b.  Operational or maintenance costs other than those
  1 17 necessary to operate and maintain the program.
  1 18    c.  Capital expenditures other than equipment or facility
  1 19 acquisition, including the lease or rental of space to
  1 20 supplement existing schoolhouse facilities.
  1 21    Sec. 3.  EFFECTIVE UPON ENACTMENT.  This Act, being deemed of
  1 22 immediate importance, takes effect upon enactment.
  1 23    Sec. 4.  APPLICABILITY.  This Act applies to school budget
  1 24 years beginning on or after July 1, 2017.
  1 25                           EXPLANATION
  1 26 The inclusion of this explanation does not constitute agreement with
  1 27 the explanation's substance by the members of the general assembly.
  1 28    Current Code section 299A.12 requires school districts to
  1 29 expend moneys received as the result of supplementary weighting
  1 30 for resident pupils receiving competent private instruction
  1 31 from a licensed practitioner for purposes of providing a home
  1 32 school assistance program and specifies the permissible and
  1 33 impermissible expenditures of such moneys.  This bill provides
  1 34 that moneys that remain unexpended or unobligated at the end of
  1 35 a budget year shall be carried forward to the succeeding budget
  2  1 year and may be used for purposes authorized under current
  2  2 law or for any of the following: (1) indirect costs or use
  2  3 charges; (2) operational or maintenance costs other than those
  2  4 necessary to operate and maintain the program; and (3) capital
  2  5 expenditures other than equipment or facility acquisition,
  2  6 including the lease or rental of space to supplement existing
  2  7 schoolhouse facilities.
  2  8    The bill takes effect upon enactment and applies to school
  2  9 budget years beginning on or after July 1, 2017.
