S.F. 35 Section 1. Section 124.204, subsection 4, Code 2011, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . ai. Any substance, compound, mixture, 3 or preparation which contains any quantity of any synthetic 4 cannabinoid that is not approved as a pharmaceutical, including 5 but not limited to the following: 6 (1) CP 47, 497 and homologues 2-[(IR, 3S)-3- 7 hydroxycyclohexyl]-5-(2-methyloctan-2-yl)phenol). 8 (2) HU-210[(6a R ,10a R )-9-(hydroxymethyl)-6,6-dimethyl-3- 9 (2-methyloctan-2-yl)-6a,7,10,10a-tetrahydrobenzo[c] 10 chromen-1-ol)]. 11 (3) HU-211(dexanabinol, (6a S ,10a S )-9-(hydroxymethyl)-6,6- 12 dimethyl-3-(2-methyloctan-2-yl)-6a,7,10,10a-tetrahydrobenzo[c] 13 chromen-1-ol). 14 (4) JWH-018 1-Pentyl-3-(1-naphthoy)indole. 15 (5) JWH-073 1-Butyl-3-(1-naphthoy)indole. 16 Sec. 2. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 17 immediate importance, takes effect upon enactment. 18 EXPLANATION 19 This bill adds certain synthetic cannabinoids to the list of 20 schedule I controlled substances. 21 The bill adds certain synthetic cannabinoids, also known 22 as “K2”, to the list of schedule I controlled substances in 23 addition to the tetrahydrocannabinols and synthetic equivalents 24 listed in schedule I under Code section 124.204(4)(u). 25 A schedule I controlled substance is considered to have a 26 high potential for abuse and no medical purpose in treatment in 27 the United States. 28 The bill makes it a class “C” felony pursuant to Code section 29 124.401, subsection 1, paragraph “c”, subparagraph (8), for any 30 unauthorized person to manufacture, deliver, or possess with 31 the intent to manufacture or deliver, a synthetic cannabinoid, 32 including its counterfeit or a simulated form, or to act with, 33 enter into a common scheme or design with, or conspire with one 34 or more other persons to manufacture, deliver, or possess with 35 -1- LSB 1554XS (3) 84 jm/nh 1/ 2
S.F. 35 the intent to manufacture or deliver a synthetic cannabinoid. 1 The bill also makes it a serious misdemeanor pursuant to Code 2 section 124.401, subsection 5, for any unauthorized person to 3 possess a synthetic cannabinoid. 4 A class “C” felony is punishable by confinement for no more 5 than 10 years and a fine of at least $1,000 but not more than 6 $10,000. A serious misdemeanor is punishable by confinement 7 for no more than one year and a fine of at least $315 but not 8 more than $1,875. 9 The bill takes effect upon enactment. 10 -2- LSB 1554XS (3) 84 jm/nh 2/ 2
