Sex
act.

The
term
“sex
act”
or
“sexual
activity”
means
any
sexual

contact
between
two
or
more
persons
by:
penetration
of
the

penis
into
the
vagina
or
anus;
contact
between
the
mouth
and

genitalia
or
by
contact
between
the
genitalia
of
one
person

and
the
genitalia
or
anus
of
another
person;
contact
between

the
finger
or
hand
of
one
person
and
the
genitalia
or
anus
9
of
another
person,
except
in
the
course
of
examination
or

treatment
by
a
person
licensed
pursuant
to
chapter
148
,
148C
,

,
or
152
;
ejaculation
onto
the
person
of
another;
or
by
use

of
artificial
sexual
organs
or
substitutes
therefor
in
contact

with
the
genitalia
or
anus.

EXPLANATION

This
bill
relates
to
the
definition
of
the
term
“sex
act”
in

the
criminal
code
and
provides
penalties.

The
bill
expands
the
definition
of
“sex
act”
to
include

ejaculation
onto
the
person
of
another.

The
bill,
by
expanding
the
definition
of
“sex
act”,
also
20
expands
the
definition
of
numerous
criminal
offenses,
including
21
but
not
limited
to
sexual
abuse
(Code
chapter
709),
lascivious
22
acts
with
a
child
(Code
section
709.8),
indecent
exposure
(Code
23
section
709.9),
sexual
exploitation
by
a
counselor,
therapist,
24
or
school
employee
(Code
section
709.15),
sexual
misconduct
25
with
offenders
or
juveniles
(Code
section
709.16),
abuse
of
a
26
corpse
(Code
section
709.18),
or
enticing
a
minor
away
(Code

section
710.10).
