1.
Section
257.41,
subsection
3,
Code
2021,
is

amended
to
read
as
follows:

3.
Limitation.
3
a.
For
the
fiscal
year
beginning
July
1,
2013,
and
each
4
succeeding
fiscal
year,
the
ratio
of
the
amount
of
the
5
modified
supplemental
amount
established
by
the
department
of
6
management
compared
to
the
school
district’s
total
regular
7
program
district
cost
shall
not
exceed
two
and
one-half
8
percent.
However,
if
the
school
district’s
highest
such
ratio
9
so
determined
for
any
fiscal
year
beginning
on
or
after
July
10
1,
2009,
but
before
July
1,
2013,
exceeded
two
and
one-half
11
percent,
the
ratio
may
exceed
two
and
one-half
percent
but
12
shall
not
exceed
the
highest
such
ratio
established
during
that
13
period.
14
b.
For
school
budget
years
beginning
on
or
after
July
15
1,
2022,
upon
resolution
by
the
board
of
directors
of
the
16
school
district,
and
if
approved
by
the
school
budget
review
17
committee,
the
ratio
of
the
amount
of
the
modified
supplemental
18
amount
established
by
the
department
of
management
compared
to
19
the
school
district’s
total
regular
program
district
cost
may
20
exceed
the
limitation
for
the
school
district
under
paragraph
21
“a”
,
but
shall
not
exceed
five
percent.
A
board
of
directors
22
shall
submit
the
board’s
request
for
a
modified
supplemental
23
amount
subject
to
the
limitation
under
paragraph
“a”
and
shall
24
submit
a
separate
request
for
the
modified
supplemental
amount
25
that
exceeds
the
limitation
under
paragraph
“a”
on
a
form
26
prescribed
by
the
department
of
management.
The
sum
of
the
27
modified
supplemental
amounts
requested
under
paragraph
“a”
28
and
this
paragraph
is
subject
to
the
requirements
contained
in
29
subsection
1.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

As
part
of
the
budget
for
a
school
district’s
program
for
34
at-risk
students,
secondary
students
who
attend
alternative

programs
and
alternative
schools,
or
returning
dropouts
and
1
dropout
prevention,
the
school
board
may
request
to
use
a
2
modified
supplemental
amount.
However,
current
law
provides
3
that
the
ratio
of
the
amount
of
the
modified
supplemental
4
amount
compared
to
the
school
district’s
total
regular
program
5
district
cost
shall
not
exceed
2.5
percent
or
the
school
6
district’s
highest
ratio
for
any
fiscal
year
beginning
on
or
7
after
July
1,
2009,
but
before
July
1,
2013,
whichever
is
8
greater.

This
bill
provides
that
for
school
budget
years
beginning
on
10
or
after
July
1,
2022,
upon
resolution
of
the
school
board,
and
11
if
approved
by
the
school
budget

committee,
the

of

the
amount
of
the
modified
supplemental
amount
established
by

the
department
of
management

to
the

The
bill
provides
for
separate
applications
for
the

modified
supplemental
amount
authorized
under
current
law
and

additional
modified
supplemental
amount
authorized
in
the

bill.
