Senate File 2348 - Enrolled Senate File 2348 AN ACT RELATING TO THE RESTORATION OF VOTING RIGHTS TO CERTAIN CONVICTED PERSONS AND INCLUDING EFFECTIVE DATE PROVISIONS. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: Section 1. Section 48A.6, subsection 1, Code 2020, is amended to read as follows: 1. A person who has been convicted of a felony as defined in section 701.7 , or convicted of an offense classified as a felony under federal law , and who has not discharged the person’s sentence as provided in section 48A.6A . If the person’s rights are later restored by the governor, or by the president of the United States, the person may register to vote. Sec. 2. NEW SECTION . 48A.6A Discharge of sentence —— definition. A person shall not be considered to have discharged a sentence for purposes of Article II, section 5, of the Constitution of the State of Iowa and section 48A.6 unless the person has done all of the following: 1. Completed any term of confinement, parole, and probation, and completed any special sentence imposed pursuant to chapter 903B. 2. For an offense under chapter 707, the offense of child endangerment resulting in the death of a child or minor under section 726.6, or election misconduct in the first degree under
Senate File 2348, p. 2 section 39A.2, received a pardon or restoration of rights from the governor. 3. Paid all pecuniary damages owed to a natural person imposed pursuant to chapter 910, as confirmed by the clerk of the court. Sec. 3. CONTINGENT EFFECTIVE DATE. This Act takes effect upon the ratification of a constitutional amendment originating in a resolution passed during the eighty-eighth general assembly relating to the restoration of the voting rights of felons upon the discharge of a criminal sentence pursuant to Article X, section 1, of the Constitution of the State of Iowa. Sec. 4. CONTINGENT REPEAL DATE.
