1.
NEW
SECTION
.
135.39E
Directed
blood
donation.
1
1.
A
blood
bank
or
other
health
facility
shall
allow
2
any
donor
qualified
to
donate
blood
under
the
criteria
for
3
donor
selection
promulgated
by
the
federal
food
and
drug
4
administration
to
direct
a
donation
of
blood
to
a
designated
5
recipient.

2.
A
blood
bank
or
other
health
facility
shall
allow
a
7
recipient
of
donated
blood
to
designate
a
donor
if
all
of
the
8
following
conditions
are
met:
9
a.
The
recipient,
or
someone
on
the
recipient’s
behalf,
has
10
solicited
the
donor.
11
b.
The
designated
donor
consents
to
the
donation.
12
c.
The
designated
donor’s
blood
may
be
obtained
in
13
sufficient
time
to
meet
the
health
care
needs
of
the
recipient.

d.
The
designated
donor
is
qualified
to
donate
blood
under
15
the
criteria
for
donor
selection
promulgated
by
the
federal
16
food
and
drug
administration.

e.
The
blood
of
the
donor
is
compatible
with
the
recipient’s
18
medical
needs.

3.
Blood
collected
as
a
directed
donation
may
be
used
20
for
someone
other
than,
or
in
addition
to,
the
designated
21
recipient
if
the
donor’s
blood
is
not
compatible
with
that
of
22
the
designated
recipient
or
if
any
part
of
the
donation
is
not
23
needed
or
used
by
the
designated
recipient.

4.
This
section
shall
not
be
construed
to
limit
other
25
procedures
or
policies
a
blood
bank
or
other
health
facility
26
may
establish
to
enable
directed
donations
of
blood.
27
5.
A
directed
donation
of
blood
to
a
designated
recipient
28
or
from
a
designated
donor
shall
be
subject
to
all
applicable
29
federal
and
state
laws,
regulations,
and
rules.

6.
For
purposes
of
this
section,
unless
the
context
31
otherwise
requires:

a.
“Blood
bank”
means
the
same
as
defined
in
section
141A.1.
33
b.
“Health
facility”
means
the
same
as
defined
in
section
34
141A.1.

1
The
inclusion
of
this
explanation
does
not
constitute
agreement
with

explanation’s

general

This
bill
authorizes
a
blood
donor
to
direct
a
blood
4
donation
to
a
specific
recipient
and
a
recipient
to
designate
a
5
specific
blood
donor.
The
bill
requires
a
blood
bank
or
health
6
facility,
as
defined
in
the
bill,
to
allow
a
directed
blood
7
donation
if
certain
conditions
are
met.
The
bill
provides
that
8
blood
collected
for
a
specific
recipient
or
from
a
specific
9
donor
that
is
either
not
compatible
with
the
needs
of
the
10
patient
or
in
excess
of
the
patient’s
needs
may
be
used
for
11
someone
else.
The
bill
provides
that
directed
donations
of
12
blood
are
subject
to
all
applicable
federal
and
state
laws,
13
regulations,
and
rules.
