S.F. 2150 Section 1. ORTHODONTIA-RELATED SERVICES. The dental board 1 shall adopt rules pursuant to chapter 17A relating to all of 2 the following: 3 1. To require that a licensee under the purview of the 4 dental board who provides treatment for the correction of 5 malpositions of human teeth or the initial use of orthodontic 6 appliances shall perform an initial in-person examination of 7 the teeth and supporting structures of the new patient prior to 8 beginning orthodontic treatment, unless the patient has been 9 referred to the licensee by another licensee who performed 10 the required initial in-person examination. The initial 11 in-person examination of the patient’s teeth and supporting 12 structures shall include any appropriate conventional or 13 digital radiographs that are necessary to develop a suitable 14 orthodontic diagnosis and treatment plan. For the purposes of 15 this subsection, “new patient” means a person whom a licensee 16 has not examined, provided care for, or otherwise provided 17 consultation to during the two-year period immediately prior to 18 the patient’s most recent appointment. 19 2. To require that a licensee who is a dentist shall only 20 delegate the performance of the scanning of the teeth and 21 supporting structures of a patient under the supervision of 22 a dentist to qualified personnel for whom such treatment is 23 authorized within such person’s scope of practice. 24 EXPLANATION 25 The inclusion of this explanation does not constitute agreement with 26 the explanation’s substance by the members of the general assembly. 27 This bill relates to orthodontia-related services. The 28 bill requires the dental board to adopt administrative rules 29 to require that a licensee under the dental board’s purview 30 who provides treatment for the correction of malpositions of 31 human teeth or initial use of orthodontic appliances to perform 32 an initial in-person examination of the teeth and supporting 33 structures of a new patient prior to beginning orthodontic 34 treatment, unless the patient has been referred to the licensee 35 -1- LSB 5983XS (1) 88 pf/rh 1/ 2

The initial in-person examination of 2 the patient’s teeth and supporting structures must include any 3 appropriate conventional or digital radiographs necessary to 4 develop a suitable orthodontic diagnosis and treatment plan. 5 The bill also requires the dental board to adopt 6 administrative rules to require that a licensee who is a 7 dentist shall only delegate the performance of the scanning 8 of the teeth and supporting structures of a patient under the 9 supervision of a dentist to qualified personnel for whom such 10 treatment is authorized within such person’s scope of practice. 11 -2- LSB 5983XS (1) 88 pf/rh 2/ 2
