  1  1    Section 1.  MEDICAID LONG=TERM SERVICES AND SUPPORTS
  1  2 POPULATION MEMBERS == PROVISION OF CONFLICT=FREE SERVICES.  The
  1  3 department of human services shall adopt rules pursuant to
  1  4 chapter 17A and shall amend existing Medicaid managed care
  1  5 contracts to ensure that services are provided under the
  1  6 Medicaid program to members of the long=term services and
  1  7 supports population in a conflict=free manner. Specifically,
  1  8 case management services shall be provided by independent
  1  9 providers, supports intensity scale (SIS) assessments shall be
  1 10 performed by independent assessors, and neither case management
  1 11 services nor SIS assessments shall be provided or performed
  1 12 through the use of internal resources or contracted resources
  1 13 of a Medicaid managed care organization under contract with the
  1 14 state.
  1 15    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of immediate
  1 16 importance, takes effect upon enactment.
  1 17                           EXPLANATION
  1 18 The inclusion of this explanation does not constitute agreement with
  1 19 the explanation's substance by the members of the general assembly.
  1 20    This bill relates to the provision of conflict=free services
  1 21 to Medicaid long=term services and supports members.  The
  1 22 bill requires the department of human services (DHS) to adopt
  1 23 administrative rules and amend existing Medicaid managed care
  1 24 contracts to ensure that services are provided under the
  1 25 Medicaid program to members of the long=term services and
  1 26 supports population in a conflict=free manner. Specifically,
  1 27 case management services shall be provided by independent
  1 28 providers, supports intensity scale (SIS) assessments shall be
  1 29 performed by independent assessors, and neither case management
  1 30 services nor SIS assessments shall be provided or performed
  1 31 through the use of internal resources or contracted resources

  1 34    The bill takes effect upon enactment.
