S.F. 2105 Section 1. NEW SECTION . 16.37 Compliance with labor and 1 employment laws in housing programs —— withholding or rescission 2 of funds —— fees. 3 1. Any contractor or subcontractor performing work pursuant 4 to a housing program shall comply with all applicable federal 5 and state laws relating to labor and employment. 6 2. The authority may withhold or rescind funding provided 7 pursuant to a housing program from any entity that does 8 not comply with subsection 1 or rules adopted to administer 9 subsection 1. 10 3. The authority shall require, as a condition of 11 participation in a housing program by a county, city, or other 12 political subdivision, or a private or nonprofit entity, that 13 the political subdivision or entity ensure compliance with 14 subsection 1 by any contractor or subcontractor retained by the 15 political subdivision or entity to perform work pursuant to the 16 housing program and facilitate implementation of subsection 2. 17 4. The authority may establish by rule pursuant to chapter 18 17A any fees necessary to cover the cost of ensuring compliance 19 with this section for a housing program. Any amount of fees 20 collected by the authority under this subsection shall be 21 considered repayment receipts as defined in section 8.2. 22 5. The authority shall reimburse a political subdivision 23 for any documented costs associated with compliance with this 24 section. Such reimbursement shall be considered a cost of 25 compliance with this section for purposes of subsection 4. 26 6. The authority shall adopt rules pursuant to chapter 17A 27 to administer this section. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill requires that any contractor or subcontractor 32 performing work pursuant to a housing program administered by 33 the Iowa finance authority comply with all applicable federal 34 and state laws relating to labor and employment. 35 -1- LSB 5229XS (2) 88 je/rn 1/ 2
