S.F. 2095 Section 1. Section 724.6, Code 2020, is amended to read as 1 follows: 2 724.6 Professional permit to carry weapons. 3 1. a. A person may be issued a permit to carry weapons when 4 the person’s employment in a private investigation business 5 or private security business licensed under chapter 80A , or a 6 person’s employment as a peace officer, correctional officer, 7 county attorney, assistant county attorney, security guard, 8 bank messenger or other person transporting property of a value 9 requiring security, or in police work, reasonably justifies 10 that person going armed. 11 b. The permit shall be on a form prescribed and published 12 by the commissioner of public safety, shall identify the 13 holder, and shall state the nature of the employment requiring 14 the holder to go armed. A permit so issued, other than to 15 a peace officer, shall authorize the person to whom it is 16 issued to go armed anywhere in the state, only while engaged 17 in the employment, and while going to and from the place of the 18 employment. 19 c. A permit issued to a county attorney or an assistant 20 county attorney shall authorize that county attorney or 21 assistant county attorney to go armed anywhere in the state 22 at all times except on the grounds of a school or beyond a 23 security screening station at a courthouse subject to the 24 rules, directives, and procedures of the judicial branch and 25 the judicial district. A county attorney or an assistant 26 county attorney seeking a professional permit to carry weapons 27 pursuant to this section shall complete a firearm safety 28 training course offered pursuant to section 724.9, subsection 29 1, paragraph “e” , and shall not be disqualified under section 30 724.8. 31 c. d. A permit issued to a certified peace officer shall 32 authorize that peace officer to go armed anywhere in the state 33 at all times, including on the grounds of a school. 34 d. e. S.F. 2095 when issued except that permits issued to peace officers and 1 correctional officers , county attorneys, and assistant county 2 attorneys are valid through the officer’s person’s period of 3 employment unless otherwise canceled. When the employment is 4 terminated, the holder of the permit shall surrender it to the 5 issuing officer for cancellation. 6 2. Notwithstanding subsection 1 , fire fighters, as defined 7 in section 411.1, subsection 10 , airport fire fighters included 8 under section 97B.49B , and emergency medical care providers, 9 as defined in section 147A.1 , county attorneys, as defined in 10 section 331.751, and assistant county attorneys, as defined 11 in section 331.757 shall not, as a condition of employment, 12 be required to obtain a permit under this section . However, 13 the provisions of this subsection shall not apply to a person 14 designated as an arson investigator by the chief fire officer 15 of a political subdivision. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 Under Code section 724.6, a person may be issued a 20 professional permit to carry weapons when the person’s 21 employment in a private investigation business or private 22 security business, or a person’s employment as a peace 23 officer, correctional officer, security guard, bank messenger 24 or other person transporting property of a value requiring 25 security, or in police work, reasonably justifies that person 26 going armed. This bill amends Code section 724.6 to allow 27 county attorneys and assistant county attorneys to obtain a 28 professional permit to carry weapons. A professional permit 29 to carry weapons issued to a county attorney or assistant 30 county attorney authorizes that person to go armed anywhere in 31 the state at all times except on the grounds of a school or 32 beyond a security screening station at a courthouse subject to 33 the rules, directives, and procedures of the judicial branch 34 and the judicial district. S.F. 2095 county attorney seeking a professional permit to carry weapons 1 pursuant to the bill shall complete a law enforcement agency 2 firearm safety training course that qualifies a peace officer 3 to carry a firearm in the normal course of the peace officer’s 4 duties, and not be disqualified from obtaining a professional 5 or nonprofessional permit to carry weapons. Permits issued 6 to county attorneys and assistant county attorneys are valid 7 through that person’s period of employment unless otherwise 8 cancelled. The bill provides that county attorneys and 9 assistant county attorneys, as a condition of their employment, 10 shall not be required to obtain a professional permit to carry 11 weapons. 12 -3- LSB 1756SZ (3) 88 js/rh 3/ 3
