S.F. 2079 Section 1. Section 139A.8, subsection 3, Code 2022, is 1 amended to read as follows: 2 3. a. Subject to the provision of subsection 4 , the state 3 board of health may modify or delete any of the immunizations 4 in subsection 2 . 5 b. (1) The provisions of this section and rules adopted 6 pursuant to this section shall be implemented uniformly 7 throughout the state and shall supersede and preempt any 8 local legislation adopted by a local governmental entity 9 that conflicts with any provision of this section related 10 to required immunizations of children for enrollment in any 11 licensed child care center or elementary or secondary school. 12 (2) For the purposes of this paragraph: 13 (a) “Local governmental entity” means any political 14 subdivision, or any state authority which is not the general 15 assembly or under the direction of a principal central 16 department as enumerated in section 7E.5, including a city as 17 defined in section 362.2, a county as provided in chapter 331, 18 or any special purpose district or school. 19 (b) “Local legislation” means any ordinance, motion, 20 amendment, regulation, or rule adopted by a local governmental 21 entity. 22 Sec. 2. Section 139A.8, subsection 4, paragraph b, Code 23 2022, is amended to read as follows: 24 b. The exemptions under this subsection do not apply in 25 times of emergency or epidemic as determined by the state board 26 of health and as declared by the director of public health. 27 Sec. 3. EFFECTIVE DATE. This Act, being deemed of immediate 28 importance, takes effect upon enactment. 29 EXPLANATION 30 The inclusion of this explanation does not constitute agreement with 31 the explanation’s substance by the members of the general assembly. 32 This bill relates to vaccinations required for enrollment 33 in any licensed child care center or elementary or secondary 34 school. 35 -1- LSB 5177SV (2) 89 pf/rh 1/ 2
S.F. 2079 The bill requires that the provisions of the Code section 1 and rules adopted pursuant to the Code section related to 2 required immunizations of children for enrollment in any 3 licensed child care center or elementary or secondary school 4 shall be implemented uniformly throughout the state and shall 5 supersede and preempt any local legislation adopted by a local 6 governmental entity that conflicts with any provision of the 7 Code section. The bill defines “local governmental entity” and 8 “local legislation” for the purposes of the bill. 9 The bill also provides that the medical and religious 10 exemptions for required vaccinations apply in times of 11 emergency or epidemic as determined by the state board of 12 health and as declared by the director of public health. 13 The bill takes effect upon enactment. 14 -2- LSB 5177SV (2) 89 pf/rh 2/ 2
