1.
Section
139A.41,
Code
2020,
is
amended
to
read
1
as
follows:

139A.41
Chlamydia
and
gonorrhea
Sexually
transmitted
3
infection
treatment.
4
Notwithstanding
any
other
provision
of
law
to
the
contrary,
5
a
physician,
physician
assistant,
or
advanced
registered
nurse
6
practitioner
who
diagnoses
a
sexually
transmitted
chlamydia
,
7
or
gonorrhea
,
or
trichomoniasis
infection
in
an
individual
8
patient
may
prescribe,
dispense,
furnish,
or
otherwise
provide
9
prescription
oral
antibiotic
drugs
to
that
patient’s
sexual
10
partner
or
partners
without
examination
of
that
patient’s
11
partner
or
partners.
If
the
infected
individual
patient
is
12
unwilling
or
unable
to
deliver
such
prescription
drugs
to
a
13
sexual
partner
or
partners,
a
physician,
physician
assistant,
14
or
advanced
registered
nurse
practitioner
may
dispense,
15
furnish,
or
otherwise
provide
the
prescription
drugs
to
the
16
department
or
local
disease
prevention
investigation
staff
for
17
delivery
to
the
partner
or
partners.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
20
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
expands
the
existing
clinical
practice
of
treating
22
the
sexual
partners
of
patients
diagnosed
with
chlamydia
or
23
gonorrhea
to
include
trichomoniasis.
Under
the
program,
if
a
24
patient
is
diagnosed
with
one
of
these
sexually
transmitted
25
infections,
the
patient’s
physician,
physician
assistant,
26
or
advanced
registered
nurse
practitioner
may
prescribe,
27
dispense,
furnish,
or
otherwise
provide
prescription
oral
28
antibiotic
drugs
to
that
patient’s
sexual
partner
or
partners
29
without
examination
of
that
patient’s
partner
or
partners.

Additionally,
if
the
infected
patient
is
unwilling
or
unable
31
to
deliver
such
prescription
drugs
to
a
sexual
partner
or
32
partners,
a
physician,
physician
assistant,
or
advanced
33
registered
nurse
practitioner
may
dispense,
furnish,
or

otherwise
provide
the
