if

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance

the
members

the
general
assembly.

This
bill
allows
the
unlicensed
sale
of
food
that
is
not
19
subject
to
time
and
temperature
controls
for
safety
to
limit
20
pathogenic
microorganism
growth
or
toxin
formation,
on
public
21
property,
or
on
private
property
with
the
consent
of
the
owner
22
of
the
private
property,
if
the
food
was
prepared
at
the
23
residence
of
the
seller
and
the
food
is
labeled
to
identify
24
the
name
and
telephone
number
of
the
person
preparing
the
25
food
and
the
common
name
of
the
food.
Current
law
exempts
26
only
a
residence
from
which
a
person
sells
certain
foods
from
27
the
definition
of
“food
establishment”
and
regulation
by
the
28
department
of
inspections
and
appeals.
