S.F. 2005 Section 1. MEDICAID EXTENDED POSTPARTUM COVERAGE 1 OPTION. The department of human services shall submit a 2 Medicaid state plan amendment to the centers for Medicare and 3 Medicaid services of the United States department of health and 4 human services for approval of the option to provide twelve 5 months of continuous postpartum coverage under the Medicaid 6 program to pregnant women enrolled in the Medicaid program in 7 accordance with section 1902(e)(16) of the Social Security Act 8 beginning April 1, 2022. 9 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 10 importance, takes effect upon enactment. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 Under current federal law, pregnant Medicaid beneficiaries 15 are eligible for at least pregnancy-related services through 16 the end of the month in which the 60-day period beginning on 17 the last day of the pregnancy ends. 18 The provision of the federal American Rescue Plan of 2021 19 (H.R. 1319) enacting section 1902(e)(16) of the Social Security 20 Act provides the option to states to submit a state plan 21 amendment to provide postpartum Medicaid coverage for 12 months 22 after the end of a pregnancy. 23 This bill requires the department of human services (DHS) 24 to submit a Medicaid state plan amendment to the centers for 25 Medicare and Medicaid services of the United States department 26 of health and human services for approval of the new option to 27 provide 12 months of continuous postpartum coverage under the 28 Medicaid program to pregnant women enrolled in the Medicaid 29 program, beginning April 1, 2022. 30 The bill takes effect upon enactment. 31 -1- LSB 5401XS (5) 89 pf/rh 1/ 1
