S.F. 197 Section 1. Section 13.31, Code 2021, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 8. Administer the sexual assault nurse 3 forensic examiner program established pursuant to section 4 915.46 for training, certifying, and providing technical 5 assistance to sexual assault nurse forensic examiners. 6 Sec. 2. NEW SECTION . 915.46 Sexual assault nurse forensic 7 examiner program. 8 1. As used in this section: 9 a. “Medical forensic services” include but are not 10 limited to, taking a medical history, performing photographic 11 documentation, performing a physical examination, assessing a 12 patient for evidence collection, collection of evidence using 13 a sexual abuse evidence collection kit, assessing a patient 14 for drug-facilitated or alcohol-facilitated sexual assault, 15 providing an evaluation of and care for sexually transmitted 16 infection and HIV, pregnancy risk evaluation and care, and 17 discharge and follow-up health care planning. 18 b. “Pediatric treatment facility” means a treatment facility 19 dealing with the development, care, and diseases of infants, 20 children, and adolescents. 21 c. “Sexual assault nurse forensic examiner” means a licensed 22 practical nurse, a registered nurse, an advanced registered 23 nurse practitioner, or an advanced practice registered nurse, 24 licensed pursuant to chapter 152 or 152E who has completed a 25 sexual assault nurse forensic examiner program that meets the 26 sexual assault nurse examiner education guidelines established 27 by the international association of forensic nurses. 28 d. “Sexual assault survivor” means a person who seeks 29 medical forensic services in relation to injuries or trauma 30 resulting from a sexual assault. 31 e. “Treatment facility” means a hospital, clinic, or 32 pediatric treatment facility that provides medical forensic 33 services to sexual assault survivors who seek medical forensic 34 services for a sexual assault within seven days of a sexual 35 -1- LSB 1525XS (5) 89 as/rh 1/ 5
S.F. 197 assault, or who have disclosed a past sexual assault by a 1 specific person while under the care of that person within 2 seven days of a sexual assault. 3 2. A sexual assault nurse forensic examiner program is 4 established within the department of justice. The sexual 5 assault nurse forensic examiner program shall maintain a list 6 of sexual assault nurse forensic examiners who have completed 7 didactic and clinical training requirements approved by the 8 department of justice and consistent with the sexual assault 9 forensic examiner education guidelines established by the 10 international association of forensic nurses. 11 3. a. By July 1, 2022, the sexual assault nurse forensic 12 examiner program shall develop and make available to treatment 13 facilities two hours of online sexual assault training for 14 sexual assault nurse forensic examiners. Notwithstanding 15 any other law regarding ongoing licensure requirements, such 16 training shall apply toward the continuing nursing education 17 credits for licensed practical nurses, registered nurses, 18 advanced registered nurse practitioners, and advanced practice 19 registered nurses. 20 b. The sexual assault nurse forensic examiner program 21 shall provide didactic and clinical training opportunities 22 consistent with the sexual assault forensic examiner education 23 guidelines established by the international association of 24 forensic nurses, in collaboration with the Iowa department of 25 public health and the Iowa coalition against sexual assault, in 26 sufficient numbers and geographical locations across the state 27 to assist treatment facilities with training sexual assault 28 nurse forensic examiners. 29 c. Sexual assault nurse forensic examiner training provided 30 under this subsection may be provided in person or online and 31 shall include but is not limited to information concerning all 32 of the following: 33 (1) The provision of medical forensic services. 34 (2) The use of a sexual abuse evidence collection kit. 35 -2- LSB 1525XS (5) 89 as/rh 2/ 5
S.F. 197 (3) Sexual assault epidemiology, the neurobiology of 1 trauma, drug-facilitated sexual assault, child sexual abuse, 2 and Iowa sexual assault-related laws. 3 (4) The treatment facility’s sexual assault-related 4 policies and procedures. 5 4. The sexual assault nurse forensic examiner program, 6 in consultation with qualified medical providers, the Iowa 7 department of public health, and the Iowa coalition against 8 sexual assault, shall create uniform materials that all 9 treatment facilities and pediatric treatment facilities are 10 required to provide to patients and non-offending parents or 11 legal guardians, if applicable, regarding medical forensic 12 examination procedures, laws regarding consent relating to 13 medical forensic services, and the benefits and risks of 14 evidence collection, including recommended time frames for 15 evidence collection pursuant to evidence-based research. 16 These materials shall be made available on the department of 17 justice’s internet site to all treatment facilities. 18 5. The sexual assault nurse forensic examiner program, 19 in consultation with qualified medical providers, the Iowa 20 department of public health, and the Iowa coalition against 21 sexual assault, shall create and update statewide sexual 22 assault nurse forensic examiner protocols, shall provide 23 technical assistance upon request to health care professionals, 24 and shall provide expertise on best practices to health care 25 professionals relating to sexual assault forensic examinations. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill establishes the sexual assault nurse forensic 30 examiner program. 31 The bill provides that the victim assistance program 32 established in the department of justice shall administer the 33 sexual assault nurse forensic examiner program established in 34 the bill (Code section 915.46) for training, certifying, and 35 -3- LSB 1525XS (5) 89 as/rh 3/ 5
S.F. 197 providing technical assistance to sexual assault nurse forensic 1 examiners. 2 The bill provides that a sexual assault nurse forensic 3 examiner program is established within the department of 4 justice. The sexual assault nurse forensic examiner program 5 shall maintain a list of sexual assault nurse forensic 6 examiners who have completed certain training requirements. 7 By July 1, 2022, the sexual assault nurse forensic examiner 8 program shall develop and make available to treatment 9 facilities two hours of online sexual assault training for 10 sexual assault nurse forensic examiners.
