S.F. 168 Section 1. Section 256.12, subsection 2, paragraph a, Code 1 2021, is amended to read as follows: 2 a. This section does not deprive the respective boards of 3 public school districts of any of their legal powers, statutory 4 or otherwise, and in accepting the specially enrolled students, 5 each of the boards shall prescribe the terms of the special 6 enrollment, including but not limited to scheduling of courses 7 and the length of class periods. In addition, the board of the 8 affected public school district shall be given notice by the 9 department of its decision to permit the special enrollment 10 not later than six months prior to the opening of the affected 11 public school district’s school year, except that the board of 12 the public school district may waive the notice requirement. 13 School districts and area education agency boards shall make 14 public school services, which shall include special education 15 programs and services and may include health services, services 16 for remedial education programs, guidance services, and school 17 testing services, available to children attending nonpublic 18 schools in the same manner and to the same extent that they are 19 provided to public school students. Service activities shall 20 be similar to those undertaken for public school students. 21 Health services, special education support, and related 22 services provided by area education agencies for the purpose 23 of identifying children with disabilities, assistance with 24 physical and communications needs of students with physical 25 disabilities, and services of an educational interpreter 26 may shall be provided on nonpublic school premises with the 27 if permission of is granted by the lawful custodian of the 28 property and the parent or guardian of the student receiving 29 the services . S.F. 168 EXPLANATION 1 The inclusion of this explanation does not constitute agreement with 2 the explanation’s substance by the members of the general assembly. 3 This bill requires that certain services and support that 4 an area education agency (AEA) must provide to a nonpublic 5 school student must, if the parent or guardian of the student 6 receiving the services grants permission, be provided on the 7 nonpublic school premises. 8 The health services, special education support, and related 9 services provided by AEAs for the purpose of identifying 10 children with disabilities, assistance with physical and 11 communications needs of students with physical disabilities, 12 and services of an educational interpreter may, under current 13 law, be provided on nonpublic school premises with the 14 permission of the lawful custodian of the property. 15 Currently, other special education services may also be 16 provided on nonpublic school premises at the discretion of 17 the school district or AEA provider of the service and with 18 the permission of the lawful custodian of the property. The 19 bill modifies the language to require that such services be 20 provided on the nonpublic school premises, but, in addition to 21 the permission of the lawful custodian of the property, the 22 bill requires the permission of the parent or guardian of the 23 student receiving the services. 24 -2- LSB 2082XS (3) 89 kh/jh 2/ 2
