S.F. 155 Section 1. Section 249A.3, subsection 1, paragraph h, Code 1 2021, is amended to read as follows: 2 h. Is a woman who, while pregnant, meets eligibility 3 requirements for assistance under the federal Social Security 4 Act, section 1902(l), and continues to meet the requirements 5 except for income. The woman is eligible to receive assistance 6 until sixty days twelve months after the date pregnancy ends. 7 Sec. 2. MEDICAID COVERAGE FOR POSTPARTUM CARE. Under 8 both fee-for-service and managed care administration of 9 Medicaid, the department of human services shall adopt rules 10 pursuant to chapter 17A, amend any contract with a managed care 11 organization, and apply for any Medicaid state plan amendment 12 or waiver as may be necessary to provide continuous Medicaid 13 eligibility for a woman for a twelve-month postpartum period, 14 if the woman applied for Medicaid coverage before the end of 15 the woman’s pregnancy, was determined to be Medicaid eligible, 16 and remains eligible for coverage during the month in which the 17 woman’s pregnancy ends. The woman’s eligibility for coverage 18 shall continue during the twelve-month postpartum period 19 beginning with the last day of the woman’s pregnancy through 20 the end of the month in which the twelve-month period ends, 21 shall continue without regard to the basis for the woman’s 22 eligibility or changes in family income or resources, and shall 23 continue in the same coverage group under which the woman 24 received Medicaid coverage while pregnant unless the woman 25 qualifies for Medicaid under another coverage group once the 26 pregnancy ends or unless the woman’s eligibility is through the 27 medically needy program. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill requires that under both fee-for-service and 32 managed care administration of Medicaid, the department of 33 human services (DHS) shall adopt administrative rules, amend 34 any contract with a managed care organization, and apply 35 -1- LSB 1098XS (5) 89 pf/rh 1/ 2
S.F. 155 for any Medicaid state plan amendment or waiver as may be 1 necessary to provide continuous Medicaid eligibility for a 2 woman for a 12-month postpartum period, if the woman applied 3 for Medicaid coverage before the end of the woman’s pregnancy, 4 was determined to be Medicaid eligible, and remains eligible 5 for coverage during the month in which the woman’s pregnancy 6 ends. The woman’s eligibility for coverage shall continue 7 during the 12-month postpartum period beginning with the last 8 day of the woman’s pregnancy through the end of the month in 9 which the 12-month period ends, shall continue without regard 10 to the basis for the woman’s eligibility or changes in family 11 income or resources, and shall continue in the same coverage 12 group under which the woman received Medicaid coverage while 13 pregnant unless the woman qualifies for Medicaid under another 14 coverage group once the pregnancy ends or unless the woman’s 15 eligibility is through the medically needy program. 16 -2- LSB 1098XS (5) 89 pf/rh 2/ 2
