Collaborative
pharmacy

practice

agreements
——
payment.

1.
For
the
purposes
of
this
section:
3
a.
“Collaborative
pharmacy
practice”
means
a
practice
of
4
pharmacy
whereby
a
pharmacist
provides
patient
care
and
drug
5
therapy
management
services,
not
otherwise
permitted
to
be
6
performed
by
a
pharmacist,
to
patients
under
a
collaborative
7
pharmacy
practice
agreement.
8
b.
“Collaborative
pharmacy
practice
agreement”
means
a
9
written
agreement
between
one
or
more
pharmacists
and
one
or
10
more
practitioners
that
provides
for
a
collaborative
pharmacy
11
practice
and
defines
the
nature,
scope,
conditions,
and
12
limitations
of
the
patient
care
and
drug
therapy
management
13
services
to
be
provided
by
a
pharmacist
in
order
to
ensure
that
14
a
patient
achieves
the
desired
outcomes.

c.
“Health
benefit
plan”
means
the
same
as
defined
in
16
section
514J.102.

d.
“Health
carrier”
means
the
same
as
defined
in
section
18
514J.102.

2.
Notwithstanding
any
provision
to
the
contrary,
a
20
pharmacist
may
engage
in
a
collaborative
pharmacy
practice,
in
21
accordance
with
rules
adopted
by
the
board
pursuant
to
chapter
22
17A
and
under
a
collaborative
pharmacy
practice
agreement,
to
23
provide
patient
care
and
drug
therapy
management
services
to
24
a
patient
including
but
not
limited
to
a
patient
following
a
25
behavioral
health
diagnosis
by
a
practitioner.

3.
Notwithstanding
any
provision
of
a
health
benefit
plan
27
to
the
contrary,
whenever
a
health
benefit
plan
provides
for
28
payment
or
reimbursement
for
a
service
that
is
within
the
29
lawful
scope
of
practice
of
a
practitioner
or
pharmacist
30
and
the
service
is
provided
by
a
pharmacist
pursuant
to
a
31
collaborative
pharmacy
practice
agreement
under
this
section,
32
the
health
carrier
may
provide
payment
or
reimbursement
for
the
33
service.

This
bill
allows
a
pharmacist
to
engage
in
a
collaborative

pharmacy
practice,
in
accordance
with
administrative
rules

adopted
by
the
board
of
pharmacy
and
under
a
collaborative

pharmacy
practice
agreement,
to
provide
patient
care
and
drug
6
therapy
management
services
to
a
patient
including
a
patient
7
following
a
behavioral
health
diagnosis
by
a
practitioner.

The
bill
also
provides
that
if
a
health
benefit
plan
provides
9
for
payment
or
reimbursement
for
a
service
that
is
within
10
the
lawful
scope
of
practice
of
a
practitioner
or
pharmacist
11
and
the
service
is
provided
by
a
pharmacist
pursuant
to
a
12
collaborative
pharmacy
practice
agreement,
the
health
carrier
13
may
provide
payment
or
reimbursement
for
the
service.
The
bill
14
provides
definitions
used
in
the
bill
including
“collaborative
15
pharmacy
practice”
and
“collaborative
pharmacy
practice
16
agreement”.
