Video

telephonic

hearings
in
criminal
proceedings.

1.
Upon
motion
of
any
of
the
parties,
an
arraignment,

pretrial
conference,
scheduling
conference,
or
any
other

noncontested
criminal
proceeding
shall
be
conducted
by
5
videoconference
or
telephone
with
the
parties
and
other
6
participants.

Upon
motion
of
any
of
the
parties,
a
hearing
in
a
8
criminal
case
may
be
conducted
by
videoconference
or
telephone
9
with
the
parties
and
other
participants
if
the
hearing
is
10
conducted
in
an
efficient
manner
and
the
hearing
does
not
11
prejudice
a
substantial
right
of
either
party.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
video
and
telephonic
hearings
in

criminal
proceedings.

The
bill
provides
that
upon
motion
of
any
party,
an
18
arraignment,
pretrial
conference,
scheduling
conference,
or
19
any
other
noncontested
criminal
proceeding
shall
be
conducted
20
by
videoconference
or
telephone
with
the
parties
and
other
21
participants.
Upon
motion
of
any
party,
a
hearing
in
a
22
criminal
case
may
be
conducted
with
the
parties
and
other
23
participants
by
videoconference
or
telephone
when
the
hearing
24
can
be
handled
efficiently
and
a
substantial
right
of
a
party
25
is
not
prejudiced.
