House Study Bill 540 - Introduced SENATE/HOUSE FILE _____ BY (PROPOSED IOWA LOTTERY AUTHORITY BILL) A BILL FOR An Act authorizing the dispensing of lottery tickets and 1 products by self-service kiosks, and including effective 2 date provisions. 3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 4 TLSB 5208DP (3) 86 ec/nh
S.F. _____ H.F. _____ Section 1. Section 99G.3, Code 2016, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 14A. “Self-service kiosk” means a machine 3 or other similar electronic device that dispenses only on-line 4 lotto tickets, instant tickets, pull-tab tickets, or other 5 printed lottery products, and that does not provide a visual 6 or audio representation of lottery game play. A “self-service 7 kiosk is not a monitor vending machine or player-activated 8 gaming machine for purposes of this chapter. 9 Sec. 2. NEW SECTION . 99G.12 Self-service kiosks. 10 1. The authority may operate self-service kiosks to 11 dispense authorized lottery tickets or products in locations 12 where lottery games and lottery products are sold, subject to 13 the requirements of this chapter. 14 2. A self-service kiosk operated to dispense authorized 15 lottery tickets or products shall meet all of the following 16 requirements: 17 a. The self-service kiosk shall be owned or leased by the 18 authority. 19 b. The self-service kiosk shall only be located in a retail 20 location licensed by the authority pursuant to this chapter. 21 The authority shall determine, in its sole discretion, the 22 placement of the self-service kiosk. 23 c. The self-service kiosk may dispense change to a purchaser 24 but shall not be used to dispense cash winnings for a lottery 25 ticket or product to a player. 26 d. The self-service kiosk shall not extend or arrange credit 27 for the purchase of a lottery ticket or product. 28 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 29 immediate importance, takes effect upon enactment. 30 EXPLANATION 31 The inclusion of this explanation does not constitute agreement with 32 the explanation’s substance by the members of the general assembly. 33 This bill authorizes the dispensing of lottery tickets and 34 products by self-service kiosks. 35 -1- LSB 5208DP (3) 86 ec/nh 1/ 2
S.F. _____ H.F. _____ Code section 99G.3 is amended to define a “self-service 1 kiosk” as a machine that dispenses only on-line lotto 2 tickets, instant tickets, pull-tab tickets, or other printed 3 lottery products, and that does not provide a visual or 4 audio representation of lottery game play. The definition 5 specifically provides that a self-service kiosk is not a 6 monitor vending machine or player-activated gaming machine. 7 New Code section 99G.12 authorizes the lottery authority 8 to operate self-service kiosks in locations where lottery 9 games and lottery products are sold so long as the kiosks are 10 owned or leased by the authority, are located and placed in 11 retail locations as authorized by the authority, and do not 12 extend or arrange credit for the purchase of a lottery ticket 13 or product. In addition, the bill permits the self-service 14 kiosk to dispense change to a purchaser but provides that the 15 kiosk shall not be used to dispense cash winnings for a lottery 16 ticket or product. 17 The bill takes effect upon enactment. 18 -2- LSB 5208DP (3) 86 ec/nh 2/ 2
