H.F. _____ Section 1. NEW SECTION . 135.29A Smoke evacuation system —— 1 requirements. 2 1. As used in this section, unless the context otherwise 3 requires: 4 a. “Ambulatory surgical center” means an outpatient surgical 5 facility as defined in section 135.61. 6 b. “Smoke evacuation system” means smoke evacuators, laser 7 plume evacuators, or local exhaust ventilators that capture and 8 neutralize plume at the site of origin and before plume can 9 make ocular contact or contact with the respiratory tract of a 10 person. 11 c. “Surgical smoke” means the by-product from the use of 12 energy-generating devices including surgical plume, smoke 13 plume, bioaerosols, laser-generated airborne contaminants, and 14 lung-damaging dust. 15 2. In order to protect patients and health care workers 16 from the hazards of surgical smoke, each hospital as defined 17 in section 135B.1 and freestanding ambulatory surgical center 18 in this state shall adopt policies, no later than July 1, 19 2021, to ensure the elimination of surgical smoke through 20 the use of a smoke evacuation system for each procedure that 21 generates surgical smoke through the use of energy-based 22 devices including but not limited to electrosurgical devices 23 and lasers. 24 3. The department of public health shall adopt rules 25 pursuant to chapter 17A to administer this section. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill requires each hospital and freestanding ambulatory 30 surgical center in the state to adopt policies, no later than 31 July 1, 2021, to ensure the elimination of surgical smoke 32 through the use of a smoke evacuation system for each procedure 33 that generates surgical smoke through the use of energy-based 34 devices including but not limited to electrosurgical devices 35 -1- LSB 5621YC (2) 88 pf/rh 1/ 2
