H.F. _____ Section 1. ADJUSTMENT OF OVERPAYMENT OF CLAIM —— LIMITED 1 TIME FRAME. Notwithstanding any provision of law to the 2 contrary, if the Medicaid program, including any managed care 3 organization contracting with the state to pay providers for 4 the cost of medical services received by Medicaid members, 5 discovers an overpayment to a provider that does not involve 6 fraud or misrepresentation, the provider shall not be subject 7 to repayment of the overpayment or to offset against future 8 reimbursement of claims by the provider if twelve months or 9 more have elapsed since such overpayment was made. 10 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 11 importance, takes effect upon enactment. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill provides that notwithstanding any provision of law 16 to the contrary, if the Medicaid program, including any managed 17 care organization contracting with the state to pay providers 18 for the cost of medical services received by Medicaid members, 19 discovers an overpayment to a provider, the provider shall not 20 be subject to repayment of the overpayment or to offset against 21 future reimbursement of claims by the provider if 12 months or 22 more have elapsed since the overpayment was made.
