agency”
means
an
agency

any
level
of
government
or
an
entity
wholly

owned,
financed,
or
controlled
by
one
or
more
such
agencies

or
departments
,
or
a
federally
recognized
Indian
tribe,

which
performs
as
its
principal
function
the
apprehension,
7
prosecution,
adjudication,
incarceration,
or
rehabilitation
of

criminal
or
juvenile
offenders.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
criminal
history
and
intelligence
data.

The
bill
provides
that
a
“criminal
or
juvenile
justice

agency”
includes
a
federally
recognized
Indian
tribe
15
which
performs
as
its
principal
function
the
apprehension,
16
prosecution,
adjudication,
incarceration,
or
rehabilitation
17
of
criminal
or
juvenile
offenders.
Under
current
law,
the
18
department
of
public
safety
may
provide
copies
or
communicate
19
information
from
criminal
history
data
to
a
criminal
or
20
juvenile
justice
agency.
Criminal
history
data
includes
data
21
concerning
arrests,
convictions,
dispositions,
corrections,
22
adjudications,
and
custody.
