H.F. 877 Section 1. Section 260C.14, subsection 2, Code 2021, is 1 amended to read as follows: 2 2. Have authority to determine tuition rates for 3 instruction. 4 a. Tuition for residents of Iowa shall not exceed the 5 lowest tuition rate per semester, or the equivalent, charged 6 by an institution of higher education under the state board of 7 regents for a full-time resident student. However, except 8 b. Except for students enrolled under section 261E.6 , if 9 a local school district pays tuition for a resident pupil of 10 high school age, the limitation on tuition for residents of 11 Iowa shall not apply, the amount of tuition shall be determined 12 by the board of directors of the community college with the 13 consent of the local school board, and the pupil shall not 14 be included in the full-time equivalent enrollment of the 15 community college for the purpose of computing general aid to 16 the community college. 17 c. Tuition for nonresidents of Iowa shall not be less than 18 the marginal cost of instruction of a student attending the 19 college. A lower tuition for nonresidents may be permitted 20 under a reciprocal tuition agreement between a merged area and 21 an educational institution in another state, if the agreement 22 is approved by the director. The board may designate that a 23 portion of the tuition moneys collected from students be used 24 for student aid purposes. 25 d. Subject to an appropriation of funds by the general 26 assembly for this purpose, and notwithstanding paragraph “c” , 27 the board shall develop and implement a program to classify 28 nonresidents as residents for purposes of tuition and mandatory 29 fees if the nonresident applicant or student agrees to live 30 and work in this state following graduation from the community 31 college for an amount of time equivalent to the amount of time 32 the individual paid in-state tuition and mandatory fee rates. 33 Sec. 2. Section 262.9, subsection 17, Code 2021, is amended 34 by adding the following new paragraph: 35 -1- LSB 2692YH (2) 89 kh/jh 1/ 2

Subject to an appropriation of funds by 1 the general assembly for this purpose, develop and implement 2 a program to classify nonresidents as residents for purposes 3 of undergraduate tuition and mandatory fees if the nonresident 4 applicant or student agrees to live and work in this state 5 following graduation from the institution for an amount of time 6 equivalent to the amount of time the individual paid in-state 7 undergraduate tuition and mandatory fee rates. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill requires the board of directors of each community 12 college and the state board of regents to develop and 13 implement a program to classify nonresidents as residents 14 for undergraduate tuition and mandatory fees purposes if the 15 nonresident applicant or student agrees to live and work 16 in this state following graduation for an amount of time 17 equivalent to the amount of time the individual paid in-state 18 tuition and mandatory fee rates. 19 -2- LSB 2692YH (2) 89 kh/jh 2/ 2
