H.F. 842 Section 1. NEW SECTION . 815.16 Fees for requests for copies 1 of documents. 2 A written request for a discovery document by a public 3 defender or public defender’s designee under the applicable 4 rules of criminal procedure shall be provided at no more than 5 ten dollars per document request unless otherwise ordered by 6 the court. A request for multiple discovery documents at 7 the same time shall be considered a single request. Digital 8 discovery documents shall be provided in a format that is 9 generally accessible to the public. However, no fee shall be 10 charged if the discovery document requested is available on a 11 cloud-based system or if the discovery document is available 12 for downloading by an individual from an existing system such 13 as a state, county, or city internet site. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 This bill relates to the assessment of fees when a public 18 defender or designee requests copies of certain documents. 19 The bill provides that a written request for a discovery 20 document by a public defender or public defender’s designee 21 shall be provided at no more than $10 per document request 22 unless otherwise ordered by the court. A request for multiple 23 discovery documents made at the same time is considered to 24 be a single request. Digital discovery documents shall be 25 provided in a format that is generally accessible to the 26 public.
